PROPOSED REGULATORY TEXT

Notice is given that the Governor in Council, pursuant to subsection 48(1) (see footnote a) of the Hazardous Materials Information Review Act (see footnote b), proposes to make the annexed Regulations Amending the Hazardous Materials Information Review Regulations and the Hazardous Materials Information Review Act Appeal Board Procedures Regulations.

Interested persons may make representations concerning the proposed Regulations within 30 days after the date of publication of this notice. REGULATIONS AMENDING THE HAZARDOUS MATERIALS INFORMATION REVIEW REGULATIONS AND THE HAZARDOUS MATERIALS INFORMATION REVIEW ACT APPEAL BOARD PROCEDURES REGULATIONS

HAZARDOUS MATERIALS INFORMATION REVIEW REGULATIONS

1. The definition “CAS registry number” in subsection 2(1) of the Hazardous Materials Information Review Regulations (see footnote 1) is repealed.

2. (1) The portion of subsection 3(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

(1) Sous réserve du paragraphe (2), aux fins d'apprécier la validité d'une demande de dérogation à l'obligation de communiquer des renseignements qui est présentée en vertu de l'article 11 de la Loi, l'agent de contrôle ou, le cas échéant, la commission d'appel prennent en considération uniquement les critères suivants :

6. Section 4 of the French version of the Hazardous Materials Information Review Act Appeal Board Procedures Regulations (see footnote 2) is replaced by the following:

La déclaration d'appel est établie conformément à la formule 1 de l'annexe et est déposée auprès de l'agent d'appel en chef selon le paragraphe 20(1) de la Loi dans les quarante-cinq jours qui suivent la date de la publication dans la Gazette du Canada, en application de l'article 18 de la Loi, de l'avis de la décision, de l'ordre ou de l'engagement faisant l'objet de l'appel.

15. (1) Subsection 22(1) of the Regulations is replaced by the following:

22. (1) Communications with the appeal board, other than at a hearing, an examination or a conference held under section 31, 32, or 33 respectively, or section 34, shall be made through the Chief Appeals Officer or any other person that is designated by the Chief Appeals Officer for that purpose.

(2) Subsection 22(2) of the French version of the Regulations is replaced by the following:

16. Subsection 33(2) of the French version of the Regulations is replaced by the following:

17. Sections 33.1 and 33.2 of the Regulations are replaced by the following:

33.1 (1) A party may make a request in writing to the appeal board for clarification by the Minister of the screening officer's record.

(2) The appeal board shall, after reviewing the request and with the unanimous approval of its members, forward the request to the Minister.

(3) The appeal board may also, on its own initiative and with the unanimous approval of its members, make a request for clarification in writing to the Minister.

(4) The Minister shall give a written response to a request as soon as possible.

APPEARANCE

33.2 (1) After receiving the response from the Minister, the party may make a request in writing to the appeal board for the appearance of the Minister at the hearing or procedural conference.

18. Subsection 35(1) of the French version of the Regulations is replaced by the following:

NOTE: Subsections 20‍(2) and (3) of the Hazardous Material Information Review Act Appeal Board Procedures Regulations provide as follows:
