Copper pipe fittings — Decisions

On April 25, 2018, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made final determinations of dumping and of subsidizing with respect to certain copper pipe fittings from Vietnam.

The subject goods are usually classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry and it will make a finding by May 25, 2018. Provisional duties will continue to be applied on imports of dumped and subsidized subject goods until the CITT concludes its inquiry and issues its finding.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping duty and/or countervailing duty will be applied to future importation of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duties.

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website or by contacting Mr. Nalong Manivong by telephone at 613-954-7268.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order on April 23, 2018, with respect to a complaint (File No. PR-2017-054) filed by Strength Tek Fitness (Strength Tek), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 100006330) by the Department of Employment and Social Development (ESDC). The solicitation was for fitness centre services.

Having examined the evidence presented by the parties, the Tribunal found that it did not have jurisdiction to continue its inquiry and, consequently, dismissed the complaint.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2018-002) from Gallason Industrial Cleaning Services Inc. (Gallason), of Fort Saskatchewan, Alberta, concerning a procurement (Solicitation No. W684E-18ES13/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of portable latrines (rental and servicing). Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on April 20, 2018, to conduct an inquiry into the complaint.

Gallason alleges that PWGSC erred in the financial evaluation of its bid.
