SPECIAL IMPORT MEASURES ACT

Certain copper tube — Decisions

On August 20, 2013, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the President of the Canada Border Services Agency (CBSA) made a preliminary determination of dumping in respect of certain copper tube originating in or exported from the Federative Republic of Brazil, the Hellenic Republic (Greece), the People’s Republic of China, the Republic of Korea and the United Mexican States and made a preliminary determination of subsidizing in respect of the above-mentioned goods originating in or exported from the People’s Republic of China.

The subject goods are usually classified under the following Harmonized System classification numbers:

  • 7411.10.00.10
  • 7411.10.00.20

The subject goods may also be classified under the following Harmonized System classification numbers:

  • 7411.10.00.31
  • 7411.10.00.39

The Canadian International Trade Tribunal (Tribunal) will conduct a full inquiry into the question of injury to the Canadian producers of certain copper tube and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing on August 20, 2013, and ending on the earlier of the day the investigations are terminated, the day on which the Tribunal makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

COMMENCEMENT OF INQUIRY

Circular copper tube

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on August 20, 2013, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping of circular copper tube with an outer diameter of 0.2 inch to 4.25 inches (0.502 centimetre to 10.795 centimetres), excluding industrial and coated or insulated copper tube, originating in or exported from the Federative Republic of Brazil, the Hellenic Republic, the People’s Republic of China, the Republic of Korea and the United Mexican States, and the subsidizing of the above-mentioned goods originating in or exported from the People’s Republic of China.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2013-004) to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Secretary on or before September 4, 2013. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before September 4, 2013.

A public hearing relating to this inquiry will be held in the Tribunal’s Hearing Room No. 1, 18th Floor, 333 Laurier Avenue W, Ottawa, Ontario, commencing on November 18, 2013, at 9:30 a.m.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

Notice of public hearing

The Northwest Territories Water Board (the “Board”) has scheduled a public hearing, pursuant to subsection 21(1) and paragraph 21(2)(a) of the Northwest Territories Waters Act, for October 7, 2013, at the Midnight Sun Recreation Complex, Inuvik, Northwest Territories, commencing at 9 a.m. The hearing will address the application of the Department of Transportation of the Government of the Northwest Territories for the issuance of a Class “A” water licence from the Board for the Inuvik Tuktoyaktuk Highway project — Application No. N7-l-1835.

The said hearing will continue in Tuktoyaktuk, Northwest Territories, on October 8, 2013, at Kitti Hall, commencing at 9 a.m.

Pursuant to Rule 79 of the Board’s Rules, any person, organization, department, agency, affected landowner and community wanting to make representations at the hearing, and not already registered as an intervenor in the proceeding, is requested to file a written notice of intention to intervene in the hearing with the Board by September 13, 2013. The said notice of intention to intervene should be made on the application form provided by the Board and available on the Board’s Web site at www.nwtwb.com. The Board will consider all such applications and notify all such applicants as to whether they have been approved for such intervenor status by September 19, 2013.

Pursuant to Rule 85, any person or organization not wishing to intervene in the hearing but wishing to make comment to the Board may

  • (a) provide written submissions to the Board and the applicant at least 10 days before the hearing date; or
  • (b) make an oral presentation during that portion of the hearing that has been set aside to hear the views of the public.
