Notice to interested parties — Review and potential amendments to the Industrial Hemp Regulations made under the Controlled Drugs and Substances Act

This notice provides interested stakeholders with the opportunity to provide comments on Health Canada’s review and potential amendments to the Industrial Hemp Regulations (IHR) and express their interest in participating in the process.

In Canada, the possession, trafficking, importation, exportation and production of all varieties of cannabis are prohibited under the Controlled Drugs and Substances Act (CDSA) unless authorized by regulations or via an exemption issued under section 56 of the CDSA. The IHR came into force in March 1998 and creates a licensing and permit scheme which allows for the production, sale, provision, importation and exportation of industrial hemp (as defined in the Regulations).

Health Canada is conducting a review of the IHR in order to respond to issues identified both internally and externally since the IHR came into force in March 1998. The intent is to undertake a comprehensive review of the IHR in order to create a more efficient framework and update the Regulations to better reflect the current hemp industry while continuing to protect the health and safety of Canadians. The review also responds to the recommendations made in the report issued by the Red Tape Reduction Commission which urges Health Canada to make changes to the IHR to “increase predictability, timeliness and transparency of the hemp licence application and approval process” and “improve service orientation and achieve greater efficiencies for Canadian growers of hemp.”

A public consultation process will take place in the fall of 2013 as part of this review. These consultations aim to engage the hemp industry, agricultural associations, provincial governments and other affected stakeholders in discussions on a range of issues pertaining to the IHR.

The publication of this notice begins a 30-day comment period on the review of the IHR. There will be additional opportunities to provide comments as this federal regulatory process progresses. This includes the public consultation process in the fall of 2013 as well as a 75-day comment period following the prepublication of the proposed regulatory amendments in the Canada Gazette, Part Ⅰ. Information received in response to this notice, the public consultation process and the 75-day comment period will inform Health Canada’s review and amendments to the IHR.

This notice announces the release of the document entitled Framework Relating to Transfers, Divisions and Subordinate Licensing of Spectrum Licences for Commercial Mobile Spectrum, which sets out changes to CPC-2-1-23, Licensing Procedure for Spectrum Licences for Terrestrial Services.

The Framework is the result of the consultation process undertaken through Canada Gazette Notice No. DGSO-002-13 — Consultation on considerations relating to transfers, divisions, and subordinate licensing of spectrum licences.
