CANADIAN INTERNATIONAL TRADE TRIBUNAL

DETERMINATION

Information processing and related telecommunications services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2015-030) on February 17, 2016, with respect to a complaint filed by Iron Mountain Information Management Services Canada, Inc. (Iron Mountain), of Brampton, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. EN929-142184/C) by the Department of Public Works and Government Services (PWGSC). The solicitation was for the provision of document imaging services.

Iron Mountain alleged that its proposal was unfairly and improperly declared non-compliant and that PWGSC improperly interpreted a mandatory technical requirement and introduced undisclosed mandatory evaluation criteria.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement, the Canada-Panama Free Trade Agreement, the Canada-Honduras Free Trade Agreement and the Canada-Korea Free Trade Agreement, the Tribunal determined that the complaint was not valid.

Transportation, travel and relocation services

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2015-058) from Sunny Jaura d.b.a. Jaura Enterprises (Jaura), of Surrey, British Columbia, concerning a procurement (Solicitation No. W0127-15PO26/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for hotel services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on February 12, 2016, to conduct an inquiry into the complaint.

Jaura alleges that PWGSC improperly evaluated its bid and wrongly awarded the contract resulting from the solicitation.

PATENTED MEDICINE PRICES REVIEW BOARD

Take notice that the Patented Medicine Prices Review Board (the “Board”) will hold a hearing in its offices in the Standard Life Centre, 333 Laurier Avenue West, 18th Floor, Ottawa, Ontario, on a date to be determined by the Hearing Panel.

The purpose of this proceeding is to receive the evidence and argument of the Staff of the Board (“Board Staff”) and Galderma Canada Inc. (the “Respondent”) on the Application by Board Staff dated January 19, 2016, for an Order, under section 81 of the Patent Act (the “Act”), requiring the Respondent to provide the Board with the information and documents referred to in section 80 of the Act and in sections 3 and 4 of the Patented Medicines Regulations.
