Issue: Whether the goods in issue are properly classified under tariff item No. 7326.90.90 as other articles of iron or steel, as determined by the President of the Canada Border Services Agency, or should be classified under tariff item No. 7308.90.00 as other structures (excluding prefabricated buildings of heading 94.06) and parts of structures (for example, bridges and bridge-sections, lock-gates, towers, lattice masts, roofs, roofing frame-works, doors and windows and their frames and thresholds for doors, shutters, balustrades, pillars and columns), of iron or steel, as claimed by Toys R Us.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2015-070) from M.D. Charlton Co. Ltd. (M.D. Charlton), of Victoria, British Colombia, concerning a procurement by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation is for night vision binoculars. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on April 6, 2016, to conduct an inquiry into the complaint.
M.D. Charlton alleges that the national security exception was improperly invoked to remove the procurement process from the disciplines of the trade agreements. M.D. Charlton also alleges that the solicitation requirements favoured a specific supplier.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-001) from The Access Information Agency Inc. (AIA), of Ottawa, Ontario, concerning a request for availability issued by the Department of Global Affairs (GAC) pursuant to the standing offer for temporary help services (E60ZN-110002/131/ZN). The solicitation is for the provision of services by a privacy consultant. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on April 11, 2016, to conduct an inquiry into the complaint.
AIA alleges that its bid was not properly evaluated, that GAC used undisclosed criteria to evaluate AIA's bid, that GAC did not provide any details relating to the evaluation of AIA's bid and that GAC did not provide AIA with information concerning the characteristics and advantages of the winning bid. AIA also objects to GAC's decision to cancel the request for availability and to issue a new one.
