EXPIRY OF FINDINGS
Pup joints
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), that its findings made on April 10, 2012, in Inquiry No. NQ-2011-001, concerning the dumping and subsidizing of oil country tubular goods pup joints, made of carbon or alloy steel, welded or seamless, heat-treated or not heat-treated, regardless of end finish, having an outside diameter from 2 3/8 inches to 4 1/2 inches (60.3 mm to 114.3 mm), in all grades, in lengths from 2 feet to 12 feet (61 cm to 366 cm), excluding casing pup joints, originating in or exported from the People's Republic of China, are scheduled to expire (Expiry No. LE-2016-001) on April 9, 2017. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.
The Tribunal's expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Tribunal on or before June 29, 2016. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 29, 2016.
On June 30, 2016, the Tribunal will distribute the list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One photocopy-ready original and five bound copies of all submissions must be served on the Tribunal.
Parties requesting or opposing the initiation of an expiry review of the findings shall file their written public submissions containing relevant information, opinions and arguments with the Tribunal, counsel and parties of record, no later than July 8, 2016. Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than July 18, 2016.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.
The Tribunal will issue a decision on August 2, 2016, on whether an expiry review is warranted. If the Tribunal decides that an expiry review is not warranted, the findings will expire on their scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

REQUEST FOR PANEL REVIEW
Polyethylene Terephthalate Resin from Canada
Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on June 6, 2016, a Request for Panel Review of the Final Affirmative Injury Determination made by the United States International Trade Commission, respecting “Polyethylene Terephthalate Resin from Canada”, was filed by counsel for Selenis Canada Inc. with the United States Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
The final determination was published in the Federal Register, on May 4, 2016 [81 Fed. Reg. 26832].
The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the above-mentioned rules provides that
- (i) a Party or interested person may challenge the final determination in whole or in part by filing a Complaint in accordance with rule 39 within 30 days after the filing of the first Request for Panel Review [the deadline for filing a Complaint is July 6, 2016];
- (ii) a Party, an investigating authority or other interested person who does not file a Complaint but who intends to participate in the panel review shall file a Notice of Appearance in accordance with rule 40 within 45 days after the filing of the first Request for Panel Review [the deadline for filing a Notice of Appearance is July 21, 2016]; and
- (iii) the panel review will be limited to the allegations of error of fact or law, including challenges to the jurisdiction of the investigating authority, that are set out in the Complaints filed in the panel review and to the procedural and substantive defenses raised in the panel review.
Notices of Appearance and Complaints pertaining to the present panel review, USA-CDA-2016-1904-01, should be filed with the United States Secretary at the NAFTA Secretariat, U.S. Section, North American Free Trade Agreement, Commerce Building, Suite 2061, 14th Street and Constitution Avenue, N.W., Washington, D.C. 20230 United States.
Explanatory note
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty panel reviews involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These rules were published in the Canada Gazette, Part I, on January 1, 1994.

NATIONAL ENERGY BOARD
APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Tidal Energy Marketing Inc.
By an application dated June 10, 2016, Tidal Energy Marketing Inc. (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to a combined 8 760 000 MWh of firm and interruptible energy annually for a period of 10 years. A list of generation facilities in which the Applicant or its affiliates have an interest (at the time of application) can be viewed at www.enbridge.com/map.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.
1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Tidal Energy Inc., 333 Seventh Avenue SW, Suite 1300, Calgary, Alberta T2P 2Z1, 403-205-7770 (telephone), and provide a copy of the application to any person who requests one. 3. Pursuant to subsection 119.06(2) of the Act, the Board is interested in the views of submitters with respect to
- (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
- (b) whether the Applicant has
- (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
- (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by August 9, 2016.

SPECIES AT RISK ACT
Description of critical habitat for the Piping Plover (melodus subspecies) in Gros Morne National Park of Canada
The Piping Plover (Charadrius melodus melodus) is listed on Schedule 1 of the Species at Risk Act as endangered. The Piping Plover (melodus subspecies) is a small (17–18 cm), stocky shorebird that nests on wide sand, gravel or cobble beaches, sandpits, or peninsulas in marine coastal areas and breeds within Canada in Newfoundland and Labrador, Quebec, Nova Scotia, Prince Edward Island, and New Brunswick. The Multi-species Action Plan for Gros Morne National Park of Canada (http://www.registrelep-sararegistry.gc.ca/default.asp?lang=En&n=561B79511) identifies one new parcel of Piping Plover critical habitat within a federally protected area.
Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, subsection 58(1) of that Act applies 90 days after the publication of this notice to the critical habitat of the Piping Plover (melodus subspecies), identified in the Multi-species Action Plan for Gros Morne National Park of Canada, which is included in the Species at Risk Public Registry, and is located at Western Brook Beach within Gros Morne National Park of Canada, the boundaries of which are described in Schedule 1 of the Canada National Parks Act.

The Public Service Commission of Canada, pursuant to section 116 of the Public Service Employment Act, hereby gives notice that it has granted permission, pursuant to subsection 114(4) of the said Act, to Shaunagh Mary Grace Stikeman, Assistant Negotiator (EC-5), Indigenous and Northern Affairs Canada, Whitehorse, Yukon, to allow her to seek nomination as a candidate before and during the election period and to be a candidate before the election period in the next territorial election for the electoral district of Mountainview, Yukon. The date of the territorial election has not been confirmed.
The Public Service Commission of Canada, pursuant to subsection 114(5) of the said Act, has also granted a leave of absence without pay during the election period, effective at close of business on the first day the employee is a candidate during the election period.
