Large line pipe — Decisions
On June 22, 2016, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain welded large diameter carbon and alloy steel line pipe (large line pipe) originating in or exported from the People's Republic of China (China) and Japan, and made a preliminary determination of subsidizing concerning large line pipe originating in or exported from China.
The goods in question are usually classified under the following Harmonized System numbers:
- 7305.11.00.21
- 7305.19.00.21
- 7305.11.00.29
- 7305.19.00.29
- 7305.12.00.20
The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determination of dumping and subsidizing.
Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing on June 22, 2016, and ending on the earlier of the day the investigations are terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.
The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

COMMENCEMENT OF INQUIRY
Welded large diameter carbon and alloy steel line pipe
Notice was received by the Canadian International Trade Tribunal (the Tribunal) on June 22, 2016, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping of welded large diameter carbon and alloy steel line pipe with an outside diameter greater than 24 inches (609.6 mm), and less than or equal to 60 inches (1,524 mm), regardless of wall thickness, length, surface finish (coated or uncoated), end finish (plain end or beveled end), or stencilling and certification (including multiple-stenciled/multiple-certified line pipe for oil and gas transmission and other applications), originating in or exported from the People's Republic of China (China) and Japan and the subsidizing of the above-mentioned goods originating in or exported from China.
For greater certainty, the goods subject to this injury inquiry include the following:
- line pipe produced to American Petroleum Institute (API) specification 5L, in Grades A25, A, B and X up to and including X100, or equivalent specifications and grades, including specification CSA Z245.1 up to and including Grade 690;
- unfinished line pipe (including pipe that may or may not already be tested, inspected, and/or certified to line pipe specifications) originating in China and Japan, and imported for use in the production or finishing of line pipe meeting final specifications, including outside diameter, grade, wall thickness, length, end finish or surface finish; and
- non-prime and secondary pipes (“limited service products”).
Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2016-001) to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before July 7, 2016. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before July 7, 2016.
A public hearing relating to this inquiry will be held in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing September 19, 2016, at 9:30 a.m., to hear evidence and representations by interested parties.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-016) from The Access Information Agency Inc. (AIA), of Ottawa, Ontario, concerning a request for proposal (Solicitation No. SPPC-1000019729) by the Public Prosecution Service of Canada (PPSC) on behalf of the Commissioner of Canada Elections. The request for proposal is for unilingual investigative services (English) and bilingual investigative services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on June 16, 2016, to conduct an inquiry into the complaint.
AIA alleges that the PPSC refused to provide the name of the purchaser and the value of the contract. AIA also alleges that the PPSC neglected to give details regarding the evaluation of its proposal and did not convey information regarding the relative advantages and characteristics of the successful proposal. Moreover, AIA contests the Commissioner of Canada Elections' argument that the proposals have expired and that they are no longer valid.

SPECIES AT RISK ACT
Description of critical habitat of Massasauga in Georgian Bay Islands National Park of Canada and Fathom Five National Marine Park of Canada
The Massasauga (Sistrurus catenatus) is listed on Schedule 1 to the Species at Risk Act as threatened. The Massasauga, eastern Canada's only venomous snake, is a stout-bodied, relatively small rattlesnake; adults are typically 50 to 70 cm long. It is found in a broad range of natural communities (e.g. forests, wetlands, grasslands, and alvars), and is known to occur in four separate regional populations in Ontario. The Recovery Strategy for the Massasauga (Sistrurus catenatus) in Canada (http://www.sararegistry.gc.ca/default.asp?lang=En&n=1696BD45-1) identifies critical habitat for the species in a number of areas, including two national parks.
Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Massasauga, as identified in the recovery strategy for that species that is included in the Species at Risk Public Registry, that is located within Georgian Bay Islands National Park of Canada and within Fathom Five National Marine Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
