Certain concrete reinforcing bar — Decision
On August 19, 2016, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated an investigation into the alleged injurious dumping of certain concrete reinforcing bar originating in or exported from the Republic of Belarus, Chinese Taipei, the Hong Kong Special Administrative Region of the People's Republic of China, Japan, the Portuguese Republic and the Kingdom of Spain.
The subject goods are usually classified under the following Harmonized System numbers:
- 7213.10.00.00
- 7214.20.00.00
- 7215.90.00.90
- 7227.90.00.90
The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

Representations
Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in the investigation, this information should be received by January 4, 2017.
Any information submitted by interested persons concerning this investigation will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2016-002) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 millimeters, in various finishes, excluding plain round bar and fabricated rebar products, originating in or exported from the Republic of Belarus, Chinese Taipei, the Hong Kong Special Administrative Region of the People's Republic of China, Japan, the Portuguese Republic and the Kingdom of Spain (the subject goods), has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA. Also excluded is 10 mm diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) that is coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 foot (30.48 cm) up to and including 8 feet (243.84 cm).
The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before September 2, 2016. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before September 2, 2016.
On September 7, 2016, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One photocopy-ready original and six bound copies of all submissions must be served on the Tribunal.
Submissions by parties opposed to the complaint must be filed not later than noon, on September 20, 2016. The complainants may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on September 27, 2016. At that time, other parties in support of the complaint may also make submissions to the Tribunal.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-001) on August 19, 2016, with respect to a complaint filed by The Access Information Agency Inc. (AIA), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a request for availability issued by the Department of Global Affairs (GAC) pursuant to the standing offer for temporary help services (E60ZN-110002/131/ZN). The solicitation was for the provision of services by a privacy consultant.
AIA alleges that its bid was not properly evaluated, that GAC used undisclosed criteria to evaluate AIA's bid, that GAC did not provide any details relating to the evaluation of AIA's bid and that GAC did not provide AIA with information concerning the characteristics and advantages of the winning bid. AIA also objected to GAC's decision to cancel the request for availability and to issue a new one.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order (File No. PR-2016-013) on August 22, 2016, with respect to a complaint filed by Unisource Technology Inc. (Unisource) of Dorval, Quebec, concerning a procurement (Solicitation No. W8486-163253/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the supply of loudspeakers.
Pursuant to subsection 30.13(5) of the Canadian International Trade Tribunal Act, the Tribunal has ceased its inquiry into the complaint and terminated all proceedings relating thereto.
