Gypsum board — Decision
On September 6, 2016, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain gypsum board originating in or exported from the United States of America, imported into Canada for use or consumption in the provinces of British Columbia, Alberta, Saskatchewan, and Manitoba, as well as the Yukon and Northwest Territories.
The goods in question are usually classified under the following Harmonized System number:
- 6809.11.00.10
The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Western Canadian industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determination of dumping.
Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing September 6, 2016, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.
The amount of provisional duty payable is not greater than the estimated margin of dumping. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

Issuance of exploration licence — Exchange of interest
Pursuant to paragraph 61(1)(b) of the Canada– Newfoundland and Labrador Atlantic Accord Implementation Act, S.C., 1987, c. 3, and paragraph 60(1)(b) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation Newfoundland and Labrador Act, R.S.N.L. 1990, c. C-2, the Canada–Newfoundland and Labrador Offshore Petroleum Board proposes to issue a new exploration licence in exchange for the surrender of existing Exploration Licence No. 1105 issued to Corridor Resources Inc. in the Canada–Newfoundland and Labrador offshore area.
The issuance of this proposed exploration licence will provide appropriate time for a robust review process associated with a proposed drilling operations authorization and validation of the geological prospect commonly referred to as Old Harry by restoring the term of the licence to four years. No drilling can occur on the proposed exploration licence lands without approval from the Canada–Newfoundland and Labrador Offshore Petroleum Board.
The issuance of this proposed interest is a fundamental decision subject to approval by the respective Accord Act ministers.
If approved, the proposed exploration licence will be issued in relation to the same lands as those associated with Exploration Licence No. 1105.

COMMENCEMENT OF INQUIRY
Gypsum board
Notice was received by the Canadian International Trade Tribunal (the Tribunal) on September 6, 2016, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that a preliminary determination had been made respecting the dumping of gypsum board, sheet, or panel (“gypsum board”) originating in or exported from the United States of America, imported into Canada for use or consumption in the provinces of British Columbia, Alberta, Saskatchewan, and Manitoba, as well as the Yukon and Northwest Territories, composed primarily of a gypsum core and faced or reinforced with paper or paperboard, including gypsum board meeting or supplied to meet ASTM C 1396 or ASTM C 1396M or equivalent standards, regardless of end use, edge-finish, thickness, width, or length, excluding (a) gypsum board made to a width of 54 inches (1,371.6 mm); (b) gypsum board measuring 1 inch (25.4 mm) in thickness and 24 inches (609.6 mm) in width regardless of length (commonly referred to and used as “paper-faced shaft liner”); (c) gypsum board meeting ASTM C 1177 or ASTM C 1177M (commonly referred to and used primarily as “glass fiber re-enforced sheathing board” but also sometimes used for internal applications for high mold/moisture resistant applications); (d) double layered glued paper-faced gypsum board (commonly referred to and used as “acoustic board”); and (e) gypsum board meeting ISO16000-23 for sorption of formaldehyde. All dimensions are plus or minus allowable tolerances in applicable standards.
Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2016-002) to determine whether the dumping of the above-mentioned goods has caused injury or retardation or is threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before September 21, 2016. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before September 21, 2016.
A public hearing relating to this inquiry will be held in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on December 5, 2016, at 9:30 a.m., to hear evidence and representations by interested parties.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-030) from L. P. Royer Inc., of Lac-Drolet, Quebec, concerning a procurement (Solicitation No. W8486-151946/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for extreme cold weather mukluks. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 6, 2016, to conduct an inquiry into the complaint.

Medical equipment, supplies and pharmaceuticals
The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-031) from Medi+Sure Canada Inc. (Medi+Sure) of Ajax, Ontario, concerning a procurement (Solicitation No. 21120-161512/A) by the Department of Public Works and Government Services (PWGSC), on behalf of Correctional Services Canada, for the supply of diabetic test strips and glucometers. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 8, 2016, to conduct an inquiry into the complaint.
Medi+Sure alleges that PWGSC awarded the contract to a bidder who did not comply with the technical requirements set out in the Request for Proposal, namely, that the strips be enclosed in a container that is tamper-resistant in order to prevent removal of the desiccant.
