DETERMINATION

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-014) on October 7, 2016, with respect to a complaint filed by CAMEC Joint Venture (CAMEC), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W8476-155245/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for shelter systems.
CAMEC alleged that PWGSC incorrectly interpreted the terms of the solicitation documents, incorrectly evaluated its bid and used undisclosed criteria when evaluating its bid.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was valid in part.

NOTICE TO INTERESTED PARTIES

On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. Application for an order
Notice is hereby given that on September 29, 2016, an application pursuant to section 79 of the Competition Act, R.S.C. 1985, c. C-34, was filed with the undersigned at the Competition Tribunal by the Commissioner of Competition, regarding certain conduct of the Vancouver Airport Authority (VAA) relating to the supply of in-flight catering at the Vancouver International Airport.
The particulars of the orders sought are as follows:
- an order pursuant to sections 79(1) and 79(2) of the Act prohibiting the VAA from directly or indirectly engaging in the practice of anti-competitive acts set out in this Application, namely (i) the VAA's ongoing refusal to grant access to the Airport airside to new-entrant firms for the supply of Galley Handling at the Airport; and (ii) the VAA's continued tying of access to the Airport airside for the supply of Galley Handling to the leasing of Airport land from the VAA for the operation of Catering kitchen facilities;
- an order pursuant to sections 79(1) and 79(2) of the Act requiring the VAA to issue authorization, on nondiscriminatory terms, to any firm that meets customary health, safety, security and performance requirements, so as to entitle that firm to access the airside at the Airport, from one or more facilities used by the firm whether located on Airport property or off Airport property, for the purposes of supplying Galley Handling;
- an order pursuant to sections 79(1) and 79(2) of the Act otherwise requiring the VAA to take any action, or to refrain from taking any action, as may be required to give effect to the foregoing prohibitions and requirements;
- an order directing the VAA to pay costs;
- an order directing the VAA to establish, and thereafter maintain, a corporate compliance program consistent with the Commissioner's bulletin entitled Corporate Compliance Programs, as such bulletin may be revised from time to time; and
- an order containing such further and other relief as the Commissioner may request and this Tribunal may consider appropriate.
Notice is hereby given that any motion for leave to intervene in this matter must be filed with the Deputy Registrar on or before November 24, 2016.
