Certain fabricated industrial steel components — Decisions
On December 6, 2016, pursuant to subsection 39(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) extended the time period for making preliminary decisions with respect to the investigations into the alleged injurious dumping of certain fabricated industrial steel components (FISC) originating in or exported from the People's Republic of China (China), the Republic of Korea, the Kingdom of Spain, the United Arab Emirates and the United Kingdom of Great Britain and Northern Ireland, and the alleged injurious subsidizing of FISC from China.
SIMA provides that, under normal circumstances, the preliminary stage of the investigation shall be completed within 90 days of the date of initiation. However, due to the complexity and novelty of the issues presented by the investigation, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA.
Consequently, the decisions to issue preliminary determinations or to terminate all or part of the investigations will be made on or before January 25, 2017.

Certain gypsum board — Decision
On December 5, 2016, pursuant to paragraph 41(1)(a) of the Special Import Measures Act, the Canada Border Services Agency (CBSA) made a final determination of dumping in respect of certain gypsum board originating in or exported from the United States of America (U.S.), imported into Canada for use or consumption in the provinces of British Columbia, Alberta, Saskatchewan, and Manitoba, as well as the Yukon and Northwest Territories (Western Canada).
The goods in question are usually classified under the following Harmonized System classification number:
6809.11.00.10
The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the Western Canadian industry and will make an order or a finding by January 4, 2017. Provisional duties relating to the dumping of the goods will continue to apply until this date on imports of subject goods from the U.S.
The CITT is also examining the question of public interest and is required to render a decision by January 4, 2017.
If the CITT finds that the dumping has caused injury or is threatening to cause injury, anti-dumping duty will be applied to the future importation of the subject goods. In that event, the importer in Canada shall pay such duty.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

NATIONAL ENERGY BOARD
APPLICATION TO CONSTRUCT AND OPERATE AN INTERNATIONAL POWER LINE
Manitoba Hydro
By an application dated December 16, 2016, Manitoba Hydro (the “Applicant”) has applied to the National Energy Board (the “Board”), under Part III.1 of the National Energy Board Act (the “Act”), for authorization to construct and operate a 500 000 V alternating current international power line. The line would extend a distance of approximately 213 km southward from the Dorsey Converter Station, located near Rosser, Manitoba, in Canada, to a point on the international boundary located south of Piney, Manitoba. The line would be constructed in accordance with the terms of the contract between Manitoba Hydro and Minnesota Power, a division of ALLETE, Inc., executed on September 29, 2016.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.
1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 360 Portage Avenue, 22nd Floor, Winnipeg, Manitoba R3C 0G8, 204-360-4539 (telephone), and provide a copy of the application to any person who requests one. 2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 517 Tenth Avenue SW, Calgary, Alberta T2R 0A8, 403-292-5503 (fax), and served on the Applicant by January 20, 2017.
3. Pursuant to subsection 58.14(2) of the Act, the Board shall have regard to all considerations that appear to be relevant. In particular, the Board is interested in the views of submitters with respect to
- (a) the effect of the power line on provinces other than those through which the line is to pass; and
- (b) the impact of the construction or operation of the power line on the environment.
4. As part of its consideration of the environmental effects of the proposed facilities, the Board will apply the Canadian Environmental Assessment Act, 2012 (the “CEAA”). The Board will ensure that there is no duplication in requirements under the CEAA and the Board's own regulatory process.
5. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by February 4, 2017.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Bruce Power Inc.
By an application dated December 16, 2016, Bruce Power Inc. (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to 7 000 000 MWh of firm energy and up to 7 000 000 MWh of interruptible energy annually for a period of 10 years. A list of generation facilities in which Bruce Power Inc. has an interest can be viewed on the application filed with the Board.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The directions on procedure that follow explain in detail the procedure that will be used.

- (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by January 31, 2017.
