PROPOSED REGULATORY TEXT
Notice is given, pursuant to subsection 210.127(1) (see footnote a) of the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act (see footnote b), that the Governor in Council, pursuant to section 210.126 (see footnote c) of that Act, proposes to make the annexed Regulations Amending the Canada – Nova Scotia Offshore Marine Installations and Structures Transitional Regulations.
Interested persons may make representations concerning the proposed Regulations within 30 days after the date of publication of this notice. Regulations Amending the Canada – Nova Scotia Offshore Marine Installations and Structures Transitional Regulations
Amendments
1 The Canada – Nova Scotia Offshore Marine Installations and Structures Transitional Regulations (see footnote 1)are amended by adding the following after section 1:
Reference
1.1 In these Regulations, any reference to a standard is to be read as a reference to the most recent version of that standard.
2 Section 2 of the Regulations is replaced by the following:
2 (1) The operator must provide
- (a) in the case of a workplace that is a manned installation, immersion suits for 200% of the total number of persons on board at any one time, that conform to the National Standard of Canada CAN/CGSB-65.16, Immersion Suit Systems, and that are stowed such that one suit is readily available adjacent to each bed and the remaining suits are equally distributed among evacuation stations; and
- (b) in the case of a workplace that is an unmanned installation, immersion suits for 100% of the total number of persons on board at any one time, that conform to the National Standard of Canada CAN/CGSB-65.16, Immersion Suit Systems, and the remaining suits are equally distributed among evacuation stations.
(2) However, if the workplace is a ship used for construction, or for geotechnical or seismic work, the immersion suits that must be provided in the workplace under subsection (1) may conform to either the National Standard of Canada CAN/CGSB-65.16, Immersion Suit Systems or the standards set out in
- (a) the International Maritime Organization's International Life-Saving Appliance (LSA) Code and Revised Recommendation on Testing of Life-Saving Appliances; and
- (b) Part I, Chapter I, Section 1.2.1 and Part II, Section 15 of the Canadian Life Saving Appliance Standard - TP 14475, published by Transport Canada.
3 The heading before section 3 of the Regulations is replaced by the following:
Firefighting Equipment
4 (1) Paragraph 3(1)(b) of the Regulations is replaced by the following:
- (b) a firefighter's helmet with visor that meets the requirements of the Canadian Standards Association (CSA) standard Z94.1, Industrial Protective Headwear — Performance, Selection, Care and Use.
(2) Subparagraph 3(2)(a)(ii) of the Regulations is replaced by the following:
- (ii) meets the requirements of Canadian Standards Association (CSA) standards Z94.4, Selection, Use, and Care of Respirators, and Z180.1, Compressed Breathing Air and Systems, and
(3) Subsections 3(3) and (4) of the Regulations are replaced by the following:
(3) However, if the workplace is a ship used for construction, or for geotechnical or seismic work, at least four sets of the required firefighting equipment must be provided and this equipment may conform with the standards set out in
- (a) regulation 10 of Chapter II-2 of the International Convention for the Safety of Life at Sea (SOLAS), 1974 , Construction – Fire protection, fire detection and fire extinction;
- (b) the International Maritime Organization's FSS Code – International Code for Fire Safety Systems; and
- (c) the Council of the European Union's Directive 96/98/EC – Marine equipment, as adopted by domestic law of member states.
(4) The equipment set out in subsections (1) to (3) must be kept ready for use and stored in a place that is easily accessible and at least one set must be easily accessible from the helicopter deck.
Coming into Force
5 These Regulations come into force on the day on which they are registered.
