Certain fabricated industrial steel components — Decisions
On April 25, 2017, pursuant to paragraph 41(1)(a) of the Special Import Measures Act, the Canada Border Services Agency (CBSA) made final determinations of dumping in respect of certain fabricated industrial steel components (FISC) originating in or exported from the People's Republic of China (China), the Republic of Korea (Korea) and the Kingdom of Spain (Spain), and subsidizing of FISC from China.

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry and it will make a finding by May 25, 2017. Provisional duties relating to the dumping and subsidizing of the goods will continue to apply until this date on imports of FISC originating in or exported from China, Korea and Spain.
If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping duty and/or countervailing duty will be applied to future importation of the subject goods. In that event, the importer in Canada shall pay such duties.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

DECISION
Supercalendered paper from Canada
Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the Final Affirmative Countervailing Duty Determination made by the United States Department of Commerce, International Trade Administration, respecting “Supercalendered Paper from Canada,” issued its decision on April 13, 2017 (Secretariat File No. USA-CDA-2015-1904-01).
In the April 13, 2017 decision, the binational panel affirmed in part and remanded in part the agency's determination respecting “Supercalendered Paper from Canada.”
The binational panel instructed the investigating authority to provide its determination on remand within 75 days of the panel decision (by June 27, 2017).
The public version of the decision is available on the NAFTA Secretariat website (www.nafta-sec-alena.org) under “Decisions and Reports” of the “Dispute Settlement” section.
EXPLANATORY NOTE
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994, and as amended on March 29, 2008.
