Call for Bids No. NS17-1
The Canada-Nova Scotia Offshore Petroleum Board (the “Board”) hereby gives notice of a call for submission of bids for three Exploration Licences covering those lands in the Nova Scotia offshore area described in Appendix I (the “Lands”) of Call for Bids No. NS17-1.
This notice of Call for Bids No. NS17-1 is made pursuant to the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act , S.C. 1988, c. 28, and the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act , S.N.S. 1987, c. 3 (the “legislation”).
The following is a summary of Call for Bids No. NS17-1:
(a ) Bids must be received by the Board before 4:00 p.m. Atlantic Daylight Time (ADT), December 14, 2017.
(b ) All bids must be submitted in accordance with the Terms and Conditions of Call for Bids No. NS17-1.
(c ) Bids must be submitted in a sealed envelope marked “CALL FOR BIDS NO. NS17-1 (Parcel # ___).”
(d ) The Board may amend this Call for Bids at any time up to 10 days prior to the Closing Date. Any amendment made to the Call for Bids shall be published on the Call for Bids website (www.callforbids.ca).
(e ) The public is provided with the opportunity to submit written comments to the Board on the Lands included in the Call for Bids. The deadline for the submission of written comments is 60 days after the announcement of the Call for Bids on the Canada-Nova Scotia Offshore Petroleum Board (CNSOPB) website. Any comments received by the deadline will be made publicly available on the Call for Bids website at www.callforbids.ca.
(f ) For the purpose of assessing and selecting a bid, the sole criterion to be used for all parcels will be the total amount of money proposed to be expended on the exploration of the parcel within Period 1 of the term of the Exploration Licence (“Work Expenditure Bid”), determined in accordance with the Schedule of Allowable Expenditures as defined in Schedule B of the Exploration Licence attached as Appendix III of Call for Bids No. NS17-1.
(g ) The minimum bid that will be considered is $1,000,000.00 of work expenditure.
(h ) The Board is not obliged to accept any bid nor is the Board required to issue an interest as the result of this Call for Bids.
(i ) Each Bid must be accompanied by a Bid Deposit in the amount of $10,000.00, in the form of a certified cheque or bank draft payable to the Receiver General for Canada. The successful bidder will receive a refund of the Bid Deposit, without interest, if the Work Deposit is posted within the time specified and any outstanding Environmental Studies Research Fund (ESRF) levies are paid as described below.
(j ) The successful bidder will be required to post security for the performance of work. The amount of the required security will be 25% of its Work Expenditure Bid. The successful bidder must post this Work Deposit within 30 days of being notified that its bid was successful, as a condition of issuance of the Exploration Licence. This Work Deposit is refundable to the extent of 25% of approved Allowable Expenditures, described in the form of the Exploration Licence.
(k ) Upon issuance of the Exploration Licence, the successful bidder must pay Environmental Studies Research Fund (ESRF) levies under Part VII of the Canada Petroleum Resources Act , R.S.C. 1985, c. 36 (2nd Supp.) [see www.esrfunds.org].
(l ) The legislation requires that a Canada-Nova Scotia Benefits Plan be submitted to, and approved by, the Board prior to the approval of any development plan, or the authorization of any other work or activity in the Nova Scotia offshore area. Canada-Nova Scotia Benefits Plan Guidelines can be found at www.cnsopb.ns.ca.
(m ) In accordance with the legislation, prior to the authorization of any petroleum-related activities on the Lands, the operator must demonstrate to the satisfaction of the Board that such activities can be conducted in an environmentally safe manner. Special precautions, such as enhanced environmental assessments, more stringent mitigation measures and environmental effects monitoring may be required in some cases.
(n ) Before carrying out any work or activity in the offshore area, an operator must first obtain an Operating Licence.
(o ) No activities related to the exploration for, development of, or transportation of petroleum on the Lands can be conducted without a specific authorization issued by the Board. Operators are required to meet certain regulatory requirements before the Board can approve offshore petroleum–related activities. The regulatory framework which governs offshore petroleum operations consists of the legislation, its regulations, and Board guidelines and policies.
(p ) Any licence that may be issued shall be in the form of the Exploration Licence attached to the Call for Bids No. NS17-1 as Appendix III.
(q ) Each resulting Significant Discovery Licence shall be in the form attached to the Call for Bids No. NS17-1 as Appendix IV.
(r ) Failure to comply with the Call for Bids or any term or condition of the Exploration Licence or resulting Significant Discovery Licence or Production Licence may result in cancellation of the respective Licence.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2017-010) on July 21, 2017, with respect to a complaint filed by MLS (Overseas) Ltd. (MLS), of Braintree, United Kingdom, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act , R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W010X-16B042/A) by the Department of Public Works and Government Services (PWGSC). The solicitation was for logistic support services of a recognized marine fuel supplier.
MLS alleged that PWGSC improperly awarded a standing offer to a bidder who, at the time of award, did not have the required security clearance.
Having examined the evidence presented by the parties and considered the provisions the Agreement on Government Procurement , the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-069) on July 25, 2017, with respect to a complaint filed by Deloitte Inc. (Deloitte), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act , R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. F5211-160590) by the Department of Fisheries and Oceans (DFO). The solicitation was for consulting services regarding the Canadian Coast Guard's Fleet Renewal Plan.
Deloitte alleged that the DFO improperly concluded that its bid did not meet the requirements of the Request for Proposal and that it used undisclosed criteria in evaluating its bid.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade , the North American Free Trade Agreement and the Agreement on Government Procurement , the Tribunal determined that the complaint was valid in part.

Carbon steel welded pipe
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(3) of the Special Import Measures Act , that its finding made on December 11, 2012, in Inquiry No. NQ-2012-003, that the dumping of carbon steel welded pipe originating in or exported from Chinese Taipei, the Republic of India, the Sultanate of Oman, the Republic of Korea, Thailand, the Republic of Turkey and the United Arab Emirates, and the subsidizing of the aforementioned goods originating in or exported from the Republic of India, the Sultanate of Oman and the United Arab Emirates, was threatening to cause injury to the domestic industry, is scheduled to expire (Expiry No. LE-2017-003) on December 10, 2017, unless the Tribunal has initiated an expiry review.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before August 25, 2017. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before August 25, 2017. The Tribunal will distribute the list of participants on October 10, 2017. The deadline for filing submissions is October 24, 2017. If there are opposing views, each party may file a response no later than November 3, 2017.
Submissions should include concise arguments and supporting evidence concerning
the likelihood of continued or resumed dumping and subsidizing of the goods;
the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;
the domestic industry's recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
the likelihood of injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry's future performance;
any other developments affecting, or likely to affect, the performance of the domestic industry;
changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
any other matter that is relevant.

EXPIRY REVIEW OF ORDER
Liquid dielectric transformers
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2017-002) of its order made on November 20, 2012, in Inquiry No. NQ-2012-001, continued without amendment by the order made on May 31, 2016, in Interim Review No. RD-2013-003, concerning the dumping of liquid dielectric transformers having a top power handling capacity equal to or exceeding 60,000 kilovolt amperes (60 megavolt amperes), whether assembled or unassembled, complete or incomplete, originating in or exported from the Republic of Korea (the subject goods).
In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping is likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than December 22, 2017. The Tribunal will issue its order and its statement of reasons no later than May 31, 2018.
Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before January 8, 2018. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before January 8, 2018.

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on March 19, 2018, at 9:30 a.m., to hear evidence and representations by interested parties. If there are no opposing parties, the Tribunal may explore the possibility of holding a file hearing, i.e. a hearing through written submissions only, instead of an oral hearing.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-021) from Telecore, of Ottawa, Ontario, concerning a procurement (Solicitation No. W0001-185315/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for headset microphones. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations , notice is hereby given that the Tribunal made a decision on July 26, 2017, to conduct an inquiry into the complaint.
Telecore alleges that PWGSC included certain technical specifications in the request for proposal that were overly restrictive.

Carbon steel welded pipe
On July 21, 2017, pursuant to paragraph 76.1(1)(b) of the Special Import Measures Act , the Minister of Finance asked the Canadian International Trade Tribunal (the Tribunal) to review its finding of December 11, 2012, in Inquiry No. NQ-2012-003, that certain carbon steel welded pipe originating in or exported from Chinese Taipei was threatening to cause injury to the domestic industry, and to have regard to the recommendations and rulings of the Dispute Settlement Body of the World Trade Organization (WTO) in relation to the WTO panel report in Canada — Anti-Dumping Measures on Imports of Certain Carbon Steel Welded Pipe from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (DS482). The Tribunal hereby gives notice that it has initiated such a review.
Each person or government wishing to participate in this review must file a notice of participation with the Tribunal on or before August 25, 2017. Each counsel who intends to represent a party in this proceeding must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before August 25, 2017.
On October 10, 2017, the Tribunal will distribute a Revised Investigation Report to the parties.
Any party wishing to file a submission must do so no later than October 24, 2017. Parties wishing to respond to the submissions must do so no later than November 3, 2017.
Submissions should consist of argument strictly in relation to the threat of injury finding, having particular regard to the Revised Investigation Report and to paragraphs 158, 159, 162, 163, 164, 165, 166 and 169 of the Tribunal's Statement of Reasons dated December 27, 2012. No new or supplemental evidence will be accepted.

Counsel and parties are required to serve their submissions on each other on the same dates they file their submissions. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Submissions that contain information that is confidential to your company/government or your client may be served by electronic means provided you are willing to accept the associated risks. Submissions that contain confidential information belonging to a company/government that is not your own or that is not represented by you must be served by courier. One electronic copy of proof of service must be served on the Tribunal.
Parties should endeavour to base their submissions on public information; however, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or edited version thereof.
By December 8, 2017, the Tribunal will make a decision either reaffirming its threat of injury finding or replacing it with a negative finding.
