CANADA BORDER SERVICES AGENCY

SPECIAL IMPORT MEASURES ACT

Certain silicon metal — Decisions

On October 3, 2017, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) terminated the dumping investigation in respect of certain silicon metal exported to Canada from the Federative Republic of Brazil (Brazil) by Rima Industrial S.A., as the goods were not dumped, and from the Kingdom of Norway by Elkem AS (Elkem), as the margin of dumping was insignificant. Similarly, the CBSA terminated the subsidy investigation in respect of certain silicon metal exported to Canada from the Kingdom of Thailand (Thailand) by Sica New Materials (Thailand) Co., Ltd. (Sica), and certain silicon metal originating in or exported from Thailand by all other exporters, as the amounts of subsidy were insignificant.

On the same day, the CBSA, pursuant to paragraph 41(1)(b) of SIMA, made a final determination of dumping in respect of certain silicon metal originating in or exported from Brazil, the Republic of Kazakhstan (Kazakhstan), Lao People's Democratic Republic (Laos), Malaysia, and Thailand, and a final determination of subsidizing in respect of certain silicon metal originating in or exported from Brazil, Kazakhstan, Malaysia, and Norway, for which the investigations have not been terminated pursuant to paragraph 41(1)(a) of SIMA.

The subject goods are usually classified under the following Harmonized System classification number:

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry, and it will make a finding by November 2, 2017. Provisional duties relating to the dumping and/or subsidizing of the goods will continue to apply until this date on imports of certain silicon metal originating in or exported from Brazil, Kazakhstan, Laos, Malaysia, Norway and Thailand. However, provisional duties related to the dumping of goods by Elkem, the subsidization of goods by Sica, and the subsidization of goods originating in or exported from Thailand by all other exporters will no longer be collected, and all duties paid or security posted during the provisional period will be returned.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping duty and/or countervailing duty will be applied to future importation of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website at http://www.cbsa-asfc.gc.ca/sima-lmsi/menu-eng.html or by contacting either Mr. Andrew Manera by telephone at 613-946-2052 or Mr. Jason Huang by telephone at 613-954-7388.
