Certain copper pipe fittings — Decisions
On October 27, 2017, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain copper pipe fittings originating in or exported from the Socialist Republic of Vietnam.
The subject goods are usually classified under the following Harmonized System numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website at www.cbsa-asfc.gc.ca/sima-lmsi or by contacting the SIMA Registry and Disclosure Unit by telephone at 613-948-4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Antidumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by March 12, 2018.
Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY
Copper pipe fittings
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2017-003) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping and subsidizing of pressure pipe fittings and drainage, waste and vent pipe fittings, made of cast copper alloy, wrought (or “wrot”) copper alloy or wrought copper for use in heating, plumbing, air conditioning and refrigeration applications, originating in or exported from the Socialist Republic of Vietnam, restricted to the products enumerated in the attached Appendix 1 (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.
The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before November 10, 2017. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 10, 2017.
On November 14, 2017, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One photocopy-ready original, four bound copies and a complete digital version of all submissions must be filed with the Tribunal.
Submissions by parties opposed to the complaint must be filed not later than noon, on November 24, 2017. The complainant may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on December 1, 2017. At that time, other parties in support of the complaint may also make submissions to the Tribunal.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Notice is hereby given that, on November 2, 2017, the Canadian International Trade Tribunal found (Inquiry No. NQ-2017-001), pursuant to subsection 43(1) of the Special Import Measures Act, that the dumping and/or subsidizing of silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes, originating in or exported from the Federative Republic of Brazil, the Republic of Kazakhstan, Lao People's Democratic Republic, Malaysia, the Kingdom of Norway and the Kingdom of Thailand, have not caused injury and are not threatening to cause injury to the domestic industry.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-032) from AirClean Systems Canada (AirClean), of Oakville, Ontario, concerning a procurement (Solicitation No. M7594-177606/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation is for the provision of negative pressure ductless fume hoods (DH II). Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 26, 2017, to conduct an inquiry into the complaint.
AirClean alleges that the Request for Standing Offer was improperly awarded to a competing bidder that did not meet the mandatory criteria.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-029) from M.D. Charlton Co. Ltd. (M.D. Charlton), of Stittsville, Ontario, concerning a procurement (Solicitation No. M0077-14-H602A) by the Royal Canadian Mounted Police (RCMP). The solicitation is for extendable baton holders. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 30, 2017, to conduct an inquiry into the complaint.
M.D. Charlton alleges that the RCMP engaged in unjustified sole-source contracting and contract splitting by purchasing the baton holders without issuing a new competitive solicitation.
