2 Person or class of persons required to prepare and implement a plan
(1) The Notice applies to any person or class of persons who owns or operates a facility within the chemical manufacturing and rubber sectors that has an industrial effluent and that manufactures or uses PREPOD, or a mixture or a compound containing PREPOD, and where the quantity of PREPOD is greater than 100 kg in 2019 or any year thereafter.
(2) The Notice applies to any person or class of persons who is the successor or assignee of the persons identified in subsection 2(1).
3 Activities in relation to which the plan is to be prepared
The Minister requires any person or class of persons identified in section 2 to prepare and implement a plan in relation to the manufacture and use of PREPOD.
4 Factors to consider in preparing the plan
The Minister requires any person or class of persons identified in section 2 to consider the following factors when preparing their plan:
(1) Final screening assessment report
PREPOD was declared toxic under section 64 of the Act and was been added to the List of Toxic Substances in Schedule 1 of the Act on December 14, 2016. According to the final screening assessment report, PREPOD is entering or may be entering the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity. The assessment report for PREPOD is available online.
(2) Risk management objective of the Notice
The risk management objective for this Notice is to reduce the presence of PREPOD in industrial effluents by reducing it below the DIPDMA LoQ of 0.12 ng/L. footnote 2 The objective should be achieved and maintained no later than 42 months after the person or class of persons becomes subject to the Notice.
(3) Sampling and analysis of samples
The sampling and analysis of samples should be completed as described below:
- (a) Sampling location
- (i) Effluent samples should be collected in such a way that they are representative of the effluent containing PREPOD released at a final discharge point under normal operating conditions;
- (ii) Samples at a specific final discharge point are not required if the effluent is not wastewater from the industrial process.
- (b) Sampling methodology
Sampling should be conducted in accordance with the methodology provided by the Environment and Climate Change Canada (ECCC) Burlington National Laboratory for Environmental Testing (NLET) in the Guide for Sampling for 2-Propanone, reaction products with diphenylamine (PREPOD - CAS RN 68412-48-6) in Industrial Effluents available on the Government of Canada website.
- (c) Event sampling
Three sampling events should be performed between the preparation and the implementation of the plan. The sampling should be representative of normal operating conditions related to the manufacture or use of PREPOD. Samples should be collected as indicated below:
- (i) the first sampling event should be conducted no later than 12 months after the person or class of persons becomes subject to the Notice;
- (ii) the second sampling event should be conducted between 12 and 24 months after the person or class of persons becomes subject to the Notice;
- (iii) the third sampling event should be conducted between 24 and 36 months after the person or class of persons becomes subject to the Notice.
A diagram representing the timelines for the PREPOD Pollution Prevention (P2) Planning Notice, Sampling and Reporting is available on the Government of Canada website.
- (d) Analysis of samples
The facility will send the samples for analysis to the NLET at the address indicated in the Guide for Sampling for 2-Propanone, reaction products with diphenylamine (PREPOD - CAS RN 68412-48-6) in Industrial Effluents available on the Government of Canada website.
The analysis of DIPDMA, as an indicator of PREPOD presence, will be performed by NLET according to the analytical method it developed. Results of the analysis will be submitted to the facility no later than 45 days after samples have been sent to the laboratory.
- (e) Sampling- and analysis-related costs
All costs related to sampling, with the exception of the analysis of samples done by the NLET, are the responsibility of the person or class of persons subject to the Notice.
(4) Priority to pollution prevention methods
In preparing a plan, a person or class of persons subject to the Notice should give first consideration to pollution prevention activities prior to considering pollution control activities. Pollution prevention is defined in CEPA as "the use of processes, practices, materials, products, substances or energy that avoid or minimize the creation of pollutants and waste and reduce the overall risk to the environment or human health."
5 Period within which the plan is to be prepared
The person or class of persons subject to the Notice will be required to prepare a plan and initiate its implementation no later than 18 months after becoming subject to the Notice, and submit a Declaration of Preparation to ECCC within 30 days after the end of that period, including first sampling results.
6 Period within which the plan is to be implemented
The person or class of persons subject to the Notice will be required to implement the plan no later than 42 months after becoming subject to the Notice, and submit a Declaration of Implementation, including the third sampling results, to ECCC within 30 days after the end of that period.
