The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA) that its order made on December 9, 2013, in Expiry Review No. RR-2012-004, continuing, without amendment, its finding made on December 11, 2008, in Inquiry No. NQ-2008-002, the dumping and subsidizing of thermoelectric containers that provide cooling and/or warming with the use of a passive heat sink and a thermoelectric module, excluding liquid dispensers, originating in or exported from the People's Republic of China, is scheduled to expire (Expiry No. LE-2018-004) on December 8, 2018, unless the Tribunal has initiated an expiry review.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before September 26, 2018. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before September 26, 2018. The Tribunal will distribute the list of participants on September 27, 2018. The deadline for filing submissions is October 5, 2018. If there are opposing views, each party may file a response no later than October 16, 2018.
Submissions should include concise argument and supporting evidence concerning
- the likelihood of continued or resumed dumping and subsidizing of the goods;
- the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;
- the domestic industry's recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the order were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry's future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
Anyone who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary, or a statement indicating why such a summary cannot be made. Please see the Tribunal's Confidentiality Guidelines.
Documents should be filed electronically through the Tribunal's Secure E-filing Service. Only one electronic copy is required.
Counsel and parties are required to serve their submissions on each other on the same dates they file their submissions. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Submissions that contain information that is confidential to your company/government or your client may be served by electronic means provided you are willing to accept the associated risks. The Tribunal will decide by October 30, 2018, on whether an expiry review is warranted. If one is not warranted, the order will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

(Horizon Maritime), of St. John's, Newfoundland and Labrador, concerning a procurement (Solicitation No. F7017-160056/C) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation is for the provision of service from two emergency towing vessels on a time charter basis. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on August 22, 2018, to conduct an inquiry into the complaint.

Certain uncoated groundwood paper from Canada
Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on September 7, 2018, a Request for Panel Review of the Final Determination of Sales at Less Than Fair Value made by the United States Department of Commerce, International Trade Administration, respecting "Certain Uncoated Groundwood Paper from Canada," was filed by counsel on behalf of Kruger Trois-Rivières L.P., Corner Brook Pulp and Paper Limited, Kruger Publication Papers Inc., and Kruger Brompton L.P. with the United States Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
The final determination was published in the Federal Register, on August 9, 2018 [83 Fed. Reg. 39412].
The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the above-mentioned rules provides that
- (i) a Party or interested person may challenge the final determination in whole or in part by filing a Complaint in accordance with rule 39 within 30 days after the filing of the first Request for Panel [the deadline for filing a Complaint is October 9, 2018];
- (ii) a Party, an investigating authority or other interested person who does not file a Complaint but who intends to participate in the panel review shall file a Notice of Appearance in accordance with rule 40 within 45 days after the filing of the first Request for Panel Review [the deadline for filing a Notice of Appearance is October 22, 2018]; and

EXPLANATORY NOTE
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These rules were published in the Canada Gazette, Part I, on January 1, 1994, and as amended on March 29, 2008.

Certain uncoated groundwood paper from Canada
Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on September 10, 2018, a Request for Panel Review of the Final Affirmative Countervailing Duty Determination made by the United States Department of Commerce, International Trade Administration, respecting "Certain Uncoated Groundwood Paper from Canada," was filed by counsel on behalf of the Government of Canada, the governments of the Provinces of Alberta, British Columbia, Newfoundland and Labrador, Ontario and Quebec, the Alberta Newsprint Company, the Catalyst Paper Corporation, Catalyst Pulp and Paper Sales Inc. and Catalyst Paper (USA) Inc., Kruger Trois-Rivières L.P., Corner Brook Pulp and Paper Limited, Kruger Publication Papers Inc. and Kruger Brompton L.P., Resolute FP Canada Inc. and Resolute FP US Inc., and Tembec Inc. with the United States Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
The final determination was published in the Federal Register on August 9, 2018 [83 Fed. Reg. 39414].
The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the above-mentioned rules provides that
