Carbon steel welded pipe — Decisions
On January 16, 2019, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) terminated the investigation in respect of certain carbon steel welded pipe exported by Erbosan Erciyas Boru Sanayii ve Ticaret A.S. from Turkey. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of dumping in respect of certain carbon steel welded pipe from Pakistan, the Philippines and Turkey, for which the investigation has not been terminated, and Vietnam.
The goods in question are usually classified under the following tariff classification numbers:
- 7306.30.00.10
- 7306.30.00.20
- 7306.30.00.30
The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decision by February 15, 2019. Provisional duties will continue to be imposed on the subject goods until the CITT renders its decision. However, provisional anti-dumping duties will no longer be imposed on imports of goods of the same description as the goods in respect of which the dumping investigation has been terminated. Any provisional duty paid or security posted will be refunded, as appropriate.
If the CITT finds that the dumping has caused injury or is threatening to cause injury, anti-dumping duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website or by contacting the SIMA Registry and Disclosure Unit by telephone at 613‑948‑4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Aluminum extrusions
The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), that its order made on March 17, 2014, in Expiry Review No. RR-2013-003, continuing, without amendment, its findings made on March 17, 2009, in Inquiry No. NQ-2008-003, as amended by its determination made on February 10, 2011, in Inquiry No. NQ-2008-003R, concerning the dumping and subsidizing of aluminum extrusions produced via an extrusion process of alloys having metallic elements falling within the alloy designations published by The Aluminum Association commencing with 1, 2, 3, 5, 6 or 7 (or proprietary or other certifying body equivalents), with the finish being as extruded (mill), mechanical, anodized or painted or otherwise coated, whether or not worked, having a wall thickness greater than 0.5 mm, with a maximum weight per metre of 22 kg and a profile or cross-section which fits within a circle having a diameter of 254 mm, excluding the products described in Appendix 1, originating in or exported from the People’s Republic of China, is scheduled to expire (Expiry No. LE-2018-008) on March 16, 2019, unless the Tribunal has initiated an expiry review.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before February 4, 2019. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before February 4, 2019. The Tribunal will distribute the list of participants on February 5, 2019. The deadline for filing submissions is February 12, 2019. If there are opposing views, each party may file a response no later than February 21, 2019.
Submissions should include concise argument and supporting evidence concerning
- the likelihood of continued or resumed dumping and subsidizing of the goods;
- the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;
- the domestic industry’s recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the order was allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry’s future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
Anyone who provides information to the Tribunal and who wishes for some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary, or a statement indicating why such a summary cannot be made. Documents should be filed electronically through the Tribunal’s Secure E-filing Service. Only one electronic copy is required.
Counsel and parties are required to serve their submissions on each other on the same dates they file their submissions. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Submissions that contain information that is confidential to your company/government or your client may be served by electronic means provided you are willing to accept the associated risks. Submissions that contain confidential information belonging to a company/government that is not your own or that is not represented by you must be served by courier. One electronic copy of proof of service must be served on the Tribunal.
The Tribunal will decide by March 8, 2019, on whether an expiry review is warranted. If not warranted, the order will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-055) from Thales Canada Inc. (Thales), of Ottawa, Ontario, concerning a procurement (Solicitation No. W8486-184111/C) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation is for transition software support services for the in-service support of the Land Command, Control, Communications, Computers, Intelligence, Surveillance and Reconnaissance System (Land C4ISR System). Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 11, 2019, to conduct an inquiry into the complaint.
Thales alleges that certain evaluation criteria were ambiguous and the evaluation process was conducted improperly, resulting in errors in the evaluation of its bid.
