Corrosion-resistant steel sheet — Decision

On January 22, 2019, pursuant to paragraph 41(1)(b) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) has made a final determination of dumping in respect of certain corrosion-resistant steel sheet from China, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), India and South Korea (subject goods).

The subject goods are usually classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the domestic industry is continuing, and it will issue its decision by February 21, 2019. Provisional duties will continue to be imposed on the subject goods until the CITT renders its finding.

If the CITT finds that the dumping has caused injury or is threatening to cause injury, anti-dumping duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

The Statement of Reasons regarding this decision will be issued within 15 days following the decision and will be available on the CBSA website or by contacting the SIMA Registry and Disclosure Unit by telephone at 613‑948‑4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Description of critical habitat of Blanding’s Turtle (Great Lakes / St. Lawrence population) in Georgian Bay Islands National Park of Canada, Point Pelee National Park of Canada and Thousand Islands National Park of Canada

The Blanding’s Turtle (Emydoidea blandingii) is a medium-sized, semi-aquatic turtle with a distinctive bright yellow chin and neck. The habitat used by the Blanding’s Turtle varies seasonally and includes upland forests as well as freshwater environments like lakes, permanent or temporary pools, slow-flowing streams, marshes and swamps. The Great Lakes / St. Lawrence population is listed on Schedule 1 of the Species at Risk Act. In Canada, this population occurs around the Great Lakes in southern Ontario and extends northwest towards the Chippewa River and east into the southwesternmost portion of Quebec.

The Recovery Strategy for the Blanding’s Turtle (Emydoidea blandingii), Great Lakes / St. Lawrence population, in Canada identifies critical habitat for this species within Georgian Bay Islands National Park of Canada, Point Pelee National Park of Canada and Thousand Islands National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Blanding’s Turtle as identified in the recovery strategy for that species that is included in the Species at Risk Public Registry, and that is located within Georgian Bay Islands National Park of Canada, Point Pelee National Park of Canada and Thousand Islands National Park of Canada, the boundaries of which are described in Schedule 1 of the Canada National Parks Act.

Description of critical habitat of Spiny Softshell in Point Pelee National Park of Canada

The Spiny Softshell (Apalone spinifera) is a medium- to large-sized aquatic turtle with a flat, leathery carapace. The species is listed on Schedule 1 of the Species at Risk Act. The Spiny Softshell is typically associated with large bodies of water such as rivers, streams or lakes, and only makes use of terrestrial habitat for nesting. In Canada, the Spiny Softshell can be found in the extreme southwest part of Ontario, from Windsor in the west to Toronto in the north and Niagara Falls in the east. There is a smaller portion of the range in the extreme southern portion of Quebec where the Ottawa River enters the St. Lawrence River, and along the border with New York.

The Recovery Strategy for the Spiny Softshell (Apalone spinifera) in Canada identifies critical habitat for the species within Point Pelee National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Spiny Softshell, identified in the recovery strategy for that species that is included in the Species at Risk Public Registry, and that is located within Point Pelee National Park of Canada, the boundaries of which are described in Schedule 1 of the Canada National Parks Act.

Description of critical habitat of Spotted Turtle in Georgian Bay Islands National Park of Canada and Point Pelee National Park of Canada

The Spotted Turtle (Clemmys guttata) is a small semi-aquatic turtle, characterized by a smooth, arched, black carapace with scattered yellow-orange spots. This species is listed on Schedule 1 of the Species at Risk Act. The habitat used by the Spotted Turtle varies seasonally, throughout the species’ geographical range and among different populations. In general, the Spotted Turtle moves among aquatic and terrestrial habitats, which can include but is not limited to shallow wetlands and marsh meadows. In Canada, the species occurs sporadically in southwestern Ontario, including along the Bruce Peninsula, and in central Ontario from the eastern shore of Georgian Bay and east to the Quebec border. The presence of the Spotted Turtle in Quebec has yet to be confirmed.
