Issue | The issue is the validity of the Canada Border Services Agency’s decision relating to the tariff classification of freeze-dried yogurts, cheeses, butter and eggs, powdered milk, quinoa, whole wheat flour, and freeze-dried fruit imported under Landmark Trade Services’ customs broker non-commercial imports account. CBSA purports to hold Landmark liable for duties owing as a result of alleged misclassification of the goods, including due to the importation of certain goods being over access commitment. Landmark argues it acted solely as an intermediary (i.e. customs broker) in the transactions and therefore contests that it has liability for the duties as the "importer" of the goods. |

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2019-011) on August 22, 2019, with respect to a complaint filed by eVision Inc. and SoftSim Technologies Inc., in joint venture (SoftSim), of Montréal, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a Request for Services (Contract No. 20182430/A) by the Privy Council Office (PCO) against Supply Arrangement No. EN578-060502. The solicitation was for a special advisor at the senior level under Stream 5F of the Supply Arrangement.
SoftSim alleged that PCO carried out this solicitation in a manner that deprived SoftSim of a fair opportunity to participate.
Having examined the evidence presented by the parties and considered the provisions of the Canadian Free Trade Agreement and the North American Free Trade Agreement, the Tribunal determined that the complaint was valid.
