Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2019-017) on October 16, 2019, with respect to a complaint filed by Pacific Northwest Raptors Ltd., of Duncan, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W0133-19H014/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of wildlife control services.

Pacific Northwest Raptors Ltd. alleged that PWGSC unfairly evaluated its proposal in that it used undisclosed criteria.

Having examined the evidence presented by the parties, the Tribunal determined that the complaint was valid.

EXPIRY OF FINDING

Concrete reinforcing bar

The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its finding made on January 9, 2015, in Inquiry No. NQ-2014-001, concerning the dumping of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 mm, in various finishes, excluding plain round bar and fabricated rebar products, originating or exported from the People’s Republic of China, the Republic of Korea and the Republic of Turkey, and the subsidizing of the aforementioned goods originating or exported from the People’s Republic of China, is scheduled to expire (Expiry No. LE-2019-002) on January 8, 2020, unless the Tribunal has initiated an expiry review. In accordance with the Tribunal’s finding in Inquiry No. NQ-2014-001, the product definition also excludes 10-mm-diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) and coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 ft (30.48 cm) up to and including 8 ft (243.84 cm).

Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before November 4, 2019. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 4, 2019. The Tribunal will distribute the list of participants on November 5, 2019. The deadline for filing submissions is November 12, 2019. If there are opposing views, each party may file a response no later than November 22, 2019.

Notice is hereby given that, on October 16, 2019, the Canadian International Trade Tribunal continued its order (Expiry Review No. RR-2018-006) in respect of the dumping of structural tubing known as hollow structural sections made of carbon and alloy steel, welded, in sizes up to and including 16.0 inches (406.4 mm) in outside diameter for round products and up to and including 48.0 inches (1,219.2 mm) in periphery for rectangular and square products, commonly but not exclusively made to ASTM A500, ASTM A513, CSA G.40.21-87-50W and comparable specifications, originating in or exported from the Republic of Korea and the Republic of Turkey.
