Corrosion-resistant steel sheet — Decision
On November 8, 2019, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain corrosion-resistant steel sheets from Turkey, the United Arab Emirates and Vietnam.
The subject goods are usually imported under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th floor, Ottawa, Ontario, K1A 0L8. To be given consideration in these investigations, this information should be received by March 17, 2020.
Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY
Corrosion-resistant steel sheet
The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2019-002) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of corrosion-resistant flat-rolled steel sheet products of carbon steel, including products alloyed with the following elements:
- Boron (B) not more than 0.01%;
- Niobium (Nb) not more than 0.100%;
- Titanium (Ti) not more than 0.08%; or
- Vanadium (V) not more than 0.300%;
in coils or cut lengths, in thicknesses up to 0.168 in. (4.267 mm) and widths up to 72 in. (1,828.8 mm) with all dimensions being plus or minus allowable tolerances contained in the applicable standards, with or without passivation and/or anti-fingerprint treatments, originating in or exported from the Republic of Turkey, the Socialist Republic of Vietnam, and the United Arab Emirates, and excluding
- corrosion-resistant steel sheet products for use in the manufacture of passenger automobiles, buses, trucks, ambulances or hearses or chassis therefor, or parts thereof, or accessories or parts thereof;
- steel products for use in the manufacture of aeronautic products;
- steel sheet that is coated or plated with tin, lead, nickel, copper, chromium, chromium oxides, both tin and lead (“terne plate”), or both chromium and chromium oxides (“tin-free steel”);
- stainless flat-rolled steel products;
- corrosion-resistant steel sheet products that have been pre-painted, including with lacquers or varnishes, or permanently coated in plastic;
- galvanized armouring tape, which is narrow flat steel tape of 3 in. or less, that has been coated by a final operation with zinc by either the hot-dip galvanizing or the electrogalvanizing process so that all surfaces, including the edges, are coated;
- perforated steel; and
- tool steel;
have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.
The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before November 21, 2019. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 21, 2019.
On November 26, 2019, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.
Submissions by parties opposed to the complaint must be filed not later than noon on December 6, 2019. The complainant, as well as supporting parties, may make submissions in response to the submissions of parties opposed to the complaint not later than noon on December 13, 2019.

EXPIRY OF ORDER
Hot-rolled carbon steel plate and high-strength low-alloy steel plate
The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act, that its order issued on January 30, 2015, in Expiry Review No. RR-2014-002, continuing, with amendment, its finding made on February 2, 2010, in Inquiry No. NQ-2009-003, concerning the dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths in widths from 24 inches (610 mm) to 152 inches (3,860 mm) inclusive and in thicknesses from 0.187 inches (4.75 mm) up to and including 3.0 inches (76.0 mm) inclusive (with all dimensions being plus or minus allowable tolerances contained in the applicable standards, e.g. ASTM standards A6/A6M and A20/A20M), originating in or exported from Ukraine, excluding universal mill plate, plate for use in the manufacture of pipe and plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), is scheduled to expire (Expiry No. LE-2019-003) on January 29, 2020, unless the Tribunal has initiated an expiry review. In accordance with the Tribunal’s order in Expiry Review No. RR-2014-002, the product definition excludes the goods listed in Appendix 1.
Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before November 28, 2019. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 28, 2019. The Tribunal will distribute the list of participants on November 29, 2019. The deadline for filing submissions is December 10, 2019. If there are opposing views, each party may file a response no later than December 19, 2019.
Submissions should include concise argument and supporting evidence concerning
- the likelihood of continued or resumed dumping of the goods;
- the likely volume and price ranges of dumped imports if dumping were to continue or resume;
- the domestic industry’s recent performance, including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
- the likelihood of injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped imports on the industry’s future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2019-044) from Bluenose Transit Inc. (Bluenose), of Cambridge, Nova Scotia, concerning a procurement (Solicitation No. W0102-20019D/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence (DND). The solicitation was to establish a Regional Individual Standing Offer for the charter of 40 to 48 passenger activity buses (with operator) for the purpose of transporting Regular Force, Cadets, and Militia personnel from 14 Wing Greenwood, Nova Scotia, to various locations within the Atlantic Provinces for DND 14 Wing Transportation Section, Greenwood, Nova Scotia. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on November 1, 2019, to conduct an inquiry into the complaint.
Bluenose alleges that the winning bid was not evaluated in accordance with the evaluation criteria stated in the request for standing offers.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2019-046) from Beyond Technologies Consulting Inc. (BTC), of Montréal, Quebec, concerning a procurement (Solicitation No. 19-147153) by the Department of Foreign Affairs, Trade and Development (DFATD). The solicitation was for Systems, Applications and Products (SAP) developer support services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on November 13, 2019, to conduct an inquiry into the complaint.
BTC alleges that the period for responding to the request for proposal issued by DFATD did not comply with the relevant provisions of the North American Free Trade Agreement.
