Corrosion-resistant steel sheet — Decision

On November 8, 2019, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain corrosion-resistant steel sheets from Turkey, the United Arab Emirates and Vietnam.

The subject goods are usually imported under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th floor, Ottawa, Ontario, K1A 0L8. To be given consideration in these investigations, this information should be received by March 17, 2020.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Corrosion-resistant steel sheet

The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2019-002) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of corrosion-resistant flat-rolled steel sheet products of carbon steel, including products alloyed with the following elements:

in coils or cut lengths, in thicknesses up to 0.168 in. (4.267 mm) and widths up to 72 in. (1,828.8 mm) with all dimensions being plus or minus allowable tolerances contained in the applicable standards, with or without passivation and/or anti-fingerprint treatments, originating in or exported from the Republic of Turkey, the Socialist Republic of Vietnam, and the United Arab Emirates, and excluding

have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before November 21, 2019. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 21, 2019.

On November 26, 2019, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon on December 6, 2019. The complainant, as well as supporting parties, may make submissions in response to the submissions of parties opposed to the complaint not later than noon on December 13, 2019.

Hot-rolled carbon steel plate and high-strength low-alloy steel plate

The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act, that its order issued on January 30, 2015, in Expiry Review No. RR-2014-002, continuing, with amendment, its finding made on February 2, 2010, in Inquiry No. NQ-2009-003, concerning the dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths in widths from 24 inches (610 mm) to 152 inches (3,860 mm) inclusive and in thicknesses from 0.187 inches (4.75 mm) up to and including 3.0 inches (76.0 mm) inclusive (with all dimensions being plus or minus allowable tolerances contained in the applicable standards, e.g. ASTM standards A6/A6M and A20/A20M), originating in or exported from Ukraine, excluding universal mill plate, plate for use in the manufacture of pipe and plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), is scheduled to expire (Expiry No. LE-2019-003) on January 29, 2020, unless the Tribunal has initiated an expiry review. In accordance with the Tribunal’s order in Expiry Review No. RR-2014-002, the product definition excludes the goods listed in Appendix 1.

Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before November 28, 2019. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 28, 2019. (Bluenose), of Cambridge, Nova Scotia, concerning a procurement (Solicitation No. W0102-20019D/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence (DND). The solicitation was to establish a Regional Individual Standing Offer for the charter of 40 to 48 passenger activity buses (with operator) for the purpose of transporting Regular Force, Cadets, and Militia personnel from 14 Wing Greenwood, Nova Scotia, to various locations within the Atlantic Provinces for DND 14 Wing Transportation Section, Greenwood, Nova Scotia. The solicitation was for Systems, Applications and Products (SAP) developer support services. On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. As indicated in Part 1 of these Rules, some broadcasting applications are posted directly on the Commission’s website, under “Part 1 Applications.”

To be up to date on all ongoing proceedings, it is important to regularly consult “Today’s Releases” on the Commission’s website, which includes daily updates to notices of consultation that have been published and ongoing proceedings, as well as a link to Part 1 applications.

The following documents are abridged versions of the Commission’s original documents. The original documents contain a more detailed outline of the applications, including the locations and addresses where the complete files for the proceeding may be examined. These documents are posted on the Commission’s website and may also be examined at the Commission’s offices and public examination rooms. Furthermore, all documents relating to a proceeding, including the notices and applications, are posted on the Commission’s website under “Public Proceedings.”
