Certain decorative and other non-structural plywood — Decisions

On January 21, 2021, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) terminated the dumping investigation in respect of certain decorative and other non-structural plywood exported from China by Celtic Co., Ltd., Linyi Evergreen Wood Co., Ltd., Linyi Huasheng Yongbin Wood Co., Ltd., Pingyi Jinniu Wood Co., Ltd., Pizhou Jiangshan Wood Co., Ltd., Shandong Good Wood Imp. and Exp. Co., Ltd., and Xuzhou Shengping Imp and Exp Co., Ltd. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of dumping concerning certain decorative and other non-structural plywood originating in or exported for all other exporters from China, for which the investigation has not been terminated.

On the same day, pursuant to paragraph 41(1)(a) of SIMA, the CBSA terminated the subsidizing investigation in respect of certain decorative and other non-structural plywood exported from China by Celtic Co., Ltd., Linyi Evergreen Wood Co., Ltd., Linyi Huasheng Yongbin Wood Co., Ltd., Linyi Jiahe Wood Industry Co., Ltd., Pingyi Jinniu Wood Co., Ltd., Pizhou Jiangshan Wood Co., Ltd., Shandong Good Wood Imp and Exp Co., Ltd., and Xuzhou Shengping Imp. and Exp. Co., Ltd. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of subsidizing concerning certain decorative and other non-structural plywood originating in or exported for all other exporters from China, for which the investigation has not been terminated.

The subject goods are usually classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decision by February 19, 2021. Provisional duty will continue to be imposed on the subject goods from China until the CITT renders its decision. However, provisional anti-dumping duty and/or countervailing duty will no longer be imposed on imports of goods of the same description as the goods in respect of which the dumping and/or subsidizing investigations have been terminated. Any provisional duty paid or security posted will be refunded, as appropriate.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, anti-dumping duty and/or countervailing duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duties.

INQUIRY

Motor vehicle maintenance and repair shop specialized equipment

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-069) from Sourcetec Industries Inc. (Sourcetec), of Mississauga, Ontario, concerning a procurement (Solicitation No. W0107-21XC02/C) made by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for temporary particle filters used to filter motor vehicle exhaust. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on December 23, 2020, to conduct an inquiry into the complaint.

Sourcetec alleges irregularities in the procurement process.
