DETERMINATION

Marine construction services

Notice is given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (file PR-2024-028) on November 21, 2024, with respect to a complaint filed by Fraser River Pile & Dredge (GP) Inc. (FRPD), of New Westminster, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, concerning a procurement (solicitation WS4399659650) by the Department of Public Works and Government Services on behalf of the Department of Fisheries and Oceans. The solicitation was for Phase II of the Okeover small craft harbour wharf reconstruction.

FRPD alleged irregularities in the procurement process and raised allegations of unfair advantage, lack of transparency and conflict of interest.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

FINDING

Certain pea protein

Notice is given that on November 19, 2024, further to the Canadian International Trade Tribunal’s inquiry (inquiry NQ-2024-002), the Tribunal found, pursuant to subsection 43(1) of the Special Import Measures Act (SIMA), that the dumping and subsidizing of certain pea protein originating in or exported from the People’s Republic of China have caused injury to the domestic industry. The Tribunal further found that there has occurred a considerable importation of the dumped subject goods, which dumping has caused injury, and that injury has been caused by a massive importation of those goods into Canada, but that the goods are not likely to seriously undermine the remedial effect of the duties applicable under subsection 3(1) of SIMA. The full description of the aforementioned goods, the list of exporters for which the dumping or subsidy investigations were terminated and the goods excluded from the finding can be found in the Tribunal’s finding.

INQUIRY

Prefabricated structures

The Canadian International Trade Tribunal has received a complaint (file PR-2024-049) from Quatrex Environnement Inc. (Quatrex), of Terrebonne, Quebec, concerning a procurement (solicitation 24-58051) made by the National Research Council of Canada. The solicitation was for the supply and delivery of an outdoor prefabricated hazardous chemical waste storage building. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on October 16, 2024, to conduct an inquiry into the complaint.

Quatrex alleges that the successful bidder’s proposal is non-compliant with the mandatory requirements of the solicitation.

ORDER

Corrosion-resistant steel sheet

Notice is given that on November 20, 2024, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal continued its finding (expiry review RR-2023-008) made on February 21, 2019, in inquiry NQ-2018-004, concerning the dumping of corrosion-resistant flat-rolled steel sheet products of carbon steel originating in or exported from the People’s Republic of China, Chinese Taipei, the Republic of India and the Republic of Korea. The full description of the aforementioned goods and the excluded goods can be found in the Tribunal’s order.
