Regulations Amending the Competency of Operators of Pleasure Craft Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 207 of the Canada Shipping Act, 2001 (see footnote a), makes the annexed Regulations Amending the Competency of Operators of Pleasure Craft Regulations.
REGULATIONS AMENDING THE COMPETENCY OF OPERATORS OF PLEASURE CRAFT REGULATIONS
AMENDMENTS
1. The definition “enforcement officer” in section 1 of the Competency of Operators of Pleasure Craft Regulations (see footnote 1) is repealed.
2. (1) Paragraph 3(1)(b) of the French version of the Regulations is replaced by the following:
- b) d’avoir à bord une preuve de compétence.
(2) Subsection 3(2) of the Regulations is amended by adding “or” at the end of paragraph (b) and by replacing paragraphs (c) and (d) with the following:
- (c) has proof on board that the person holds a certificate of competency, training certificate, endorsement or other equivalency listed in the schedule.
(3) Subsection 3(2.1) of the Regulations is replaced by the following:
(2.1) No person in charge of a pleasure craft shall allow another person to operate the pleasure craft unless that other person is a person referred to in subsection (1) or (2).
(4) Subsection 3(4) of the Regulations is replaced by the following:
(4) Except where replacing a previously issued card or issuing a card to a person providing proof that the person holds a certificate of competency, training certificate, endorsement or other equivalency listed in the schedule, no course provider shall issue a Pleasure Craft Operator Card to a candidate unless the provider or their agent has administered to the candidate a test that meets the requirements of section 7.
3. (1) Paragraphs 4(1)(b) and (c) of the Regulations are replaced by the following:
- (b) if the person had successfully completed a recreational boating safety course in Canada before April 1, 1999 and has a Boating Safety Course Completion Card or other written proof of that completion; or
- (c) in the case of a pleasure craft rented from a rental agency or from a representative of a rental agency,
- (i) if the person meets the condition set out in paragraphs (a) or (b), or
- (ii) if the person and the agency or representative complete and sign, before the pleasure craft is operated, a rental boat safety checklist that contains the information referred to in section 8 and the person operates the pleasure craft only during the rental period.
(2) Paragraph 4(2)(b) of the Regulations is replaced by the following:
- (b) has been issued a certificate or other similar document that meets the requirements of the person’s state or country.
4. (1) Subparagraphs 6(2)(e)(i) and (ii) of the Regulations are replaced by the following:
- (i) the Canada Shipping Act, 2001,
- (ii) the provisions of the Contraventions Act and the regulations made under it that pertain to contraventions of the Canada Shipping Act, 2001 and the regulations made under it,
(2) Subparagraph 6(2)(e)(iv) of the Regulations is replaced by the following:
- (iv) the Vessel Operation Restriction Regulations,

REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Background
The Competency of Operators of Pleasure Craft Regulations (the Regulations) establish competency requirements for operators of pleasure craft, which are vessels used for recreational purposes that are fitted with a motor. The Regulations are designed to reduce the number of boating-related incidents and fatalities through education and training. Certificates of competency, training certificates, endorsements and other equivalencies are recognized as proof of competency under the Regulations.
The Standing Joint Committee for the Scrutiny of Regulations (SJCSR) reviews matters of legality and the procedural aspects of federal regulations.
Issue
The SJCSR reviewed the Regulations and provided comments in letters dated August 1, 2007, and August 7, 2007, respectively. The SJCSR raised the following issues that require amendments:
- the definition of “enforcement officer” is not needed in the Regulations as it is already defined in the Canada Shipping Act, 2001 (CSA 2001);
- the certificates and endorsements accepted as proof of competency, including the authority under which they were issued, was not clear, as certain certificates were issued under previous regulations which have since been repealed and replaced by a new regulation; and
- inconsistencies in language and grammar used in the Regulations (both in English and French).
In addition to the amendments noted above, additional minor changes are required to certain provisions to ensure greater clarity to existing provisions or update references to the CSA 2001 and regulatory titles, where applicable.
Objectives
The objectives of the Regulations Amending the Competency of Operators of Pleasure Craft Regulations are to ensure that all language in the Regulations is consistent in both official languages, to provide clarity, to follow up on comments, concerns and recommendations made by the SJCSR concerning the Regulations, and to make other minor amendments.
Description
As noted by the SJCSR, subsection 209(1) of the CSA 2001 expressly sets out administrative directions, the contravention of which will constitute an offence, while section 194 of the CSA 2001 provides the definition of an “enforcement officer.” As a result, the definition of “enforcement officer” in the Regulations has become unnecessary and is repealed.
The powers of enforcement officers in respect of pleasure craft are extensively dealt with in Part X of the CSA 2001. Therefore, sections 8.1 and 8.2 of the Regulations have been examined and it has been determined that they are redundant and no longer continue to serve any purpose, and are repealed.
Paragraph 3(1)(b), subsections 3(4) and 7(1) and subparagraphs 7(2)(d)(iii) and 7(3)(c)(i) of the Regulations are amended to reflect grammatical clarifications. For example, the French version of the opening portion of subsection 7(1) will be improved grammatically by replacing the phrase “que s’il est conforme aux conditions suivantes” with the phrase “sauf s’il est conforme aux conditions suivantes.” As another example, the comma following the word “necessary” is deleted from the English version of subparagraph 7(3)(c)(i) in order to clarify that the word “necessary” is intended to modify the phrase “through a competent and independent interpreter” rather than the word “orally.” The changes to paragraph 3(1)(b), subsections 3(4) and 7(1) and subparagraphs 7(2)(d)(iii) and 7(3)(c)(i) will ensure that the English and French versions of the Regulations are consistent.
In addition, subsections 3(2) and (4) of the Regulations are amended to remove references to the Marine Certification Regulations, which were repealed with the coming into force of the Marine Personnel Regulations on July 1, 2007. A new schedule to the Regulations is added to clearly list the certificates of competency, training certificates, endorsements and other equivalencies recognized as proof of competency under the Regulations. For clarity, subsection 3(2.1) is amended and subparagraph 4(1)(c)(i) and section 8 of the Regulations are amended to specify “a rental agency or representative of a rental agency.” Paragraph 4(1)(b) is amended to clarify that a person is competent to operate a pleasure craft if the person has successfully completed a “recreational” boating course and paragraph 4(2)(b) is amended to clarify that it is a certificate or other similar document that meets the requirements of the state or country, but does not necessarily have to have been issued by the person’s state or country.
Subparagraphs 6(2)(e)(i), 6(2)(e)(ii) and 6(2)(e)(iv) are amended to update the references to the Canada Shipping Act, 2001 and the Vessel Operation Restriction Regulations, where applicable.
Subsection 7(2) of the Regulations is amended to address the reference to “in the Minister’s opinion.” As a general principle, subordinate legislation governing the making of decisions by public officials should be cast in objective, rather than subjective terms. Therefore, the words “in the Minister’s opinion” are deleted from both the English and French versions of the Regulations.
All amendments are minor and do not make any substantive changes to any of the provisions identified, nor do they reflect any changes in policy.
Consultation
For the most part, the amendments to the Regulations address recommendations from the SJCSR and are administrative in nature. Formal consultations on these amendments were not undertaken, as the changes will have no effect on the specifications of the Regulations and will not impact stakeholders, apart from making the Regulations more accessible through improved consistency between the English and French versions.
“One-for-One” Rule
The “One-for-One” Rule does not apply to this proposal, as there is no change in administrative costs to business.
Small business lens
The small business lens does not apply to this proposal, as there are no costs for small business.
Rationale
The Regulations Amending the Competency of Operators of Pleasure Craft Regulations address concerns raised by the SJCSR. These amendments are administrative in nature. Additional amendments are minor in nature and are intended only to clarify the meaning of certain existing provisions.
Implementation, enforcement and service standards
The amendments are minor and do not make any substantive changes to any of the provisions identified. As these amendments are administrative in nature, there is no enforcement plan required and, as a result, the amendments will not affect Transport Canada’s current enforcement activities.
