Order Fixing June 1, 2015 as the Day on which Sections 169 and 170 of the Act Come into Force
P.C. 2015-564 May 7, 2015
His Excellency the Governor General in Council, on the recommendation of the Minister of National Defence, pursuant to subsection 171(2) of the Economic Action Plan 2014 Act, No. 1, chapter 20 of the Statutes of Canada, 2014, fixes June 1, 2015 as the day on which sections 169 and 170 of that Act come into force.
EXPLANATORY NOTE
(This note is not part of the Order.)
This Order in Council fixes June 1, 2015, as the day on which sections 169 and 170 of the Economic Action Plan 2014 Act, No. 1, chapter 20 of the Statutes of Canada, 2014 (the Act), come into force.
Sections 169 and 170 of the Act amend section 21 and the schedule of the National Defence Act (NDA) respectively. This Order brings these amendments into force.
Before the coming into force of these amendments, the schedule to the NDA laid down the ranks of officers and non-commissioned members of the Canadian Forces as well as the designation of ranks (columns I to IV). Subsection 21(2) of the NDA provided that the Governor in Council may make regulations prescribing the circumstances in which a person holding a rank set out in column I of the schedule shall use, or be referred to by, a designation of rank set out in column II, III or IV of the schedule opposite the rank held by that person.
As a result of the amendments, the designation of ranks is no longer set out in the schedule to the NDA. The schedule only sets out the ranks for the Canadian Forces. The amendments empower the Governor in Council to both prescribe in regulations the designation of ranks as well as the circumstances.
