Regulations Amending and Repealing Certain Regulations Made Under the Health of Animals Act

The Minister of Agriculture and Agri-Food, pursuant to sections 14 and 55 (see footnote a) of the Health of Animals Act (see footnote b), makes the annexed Regulations Amending and Repealing Certain Regulations Made Under the Health of Animals Act.

REGULATIONS AMENDING AND REPEALING CERTAIN REGULATIONS MADE UNDER THE HEALTH OF ANIMALS ACT

COMPENSATION FOR DESTROYED ANIMALS REGULATIONS

1. (1) The definition “reproducteur grand-parent” in section 1 of the French version of the Compensation for Destroyed Animals Regulations (see footnote 1) is replaced by the following:

« reproducteur grand-parent » Oiseau originaire d’un troupeau de volailles de lignée pure qui est composé d’une ou de plusieurs générations de volailles, qui est entretenu pour la création, la multiplication ou l’amélioration des lignées parentales, et qui sert à la création de lignées parentales. (grandparent breeder)

(2) Section 1 of the Regulations is amended by adding the following in alphabetical order:

“registered” for the purposes of the schedule, means registered under the Animal Pedigree Act. (enregistré)

PRAIRIE DOG AND CERTAIN OTHER RODENTS IMPORTATION PROHIBITION REGULATIONS

2. The Prairie Dog and Certain Other Rodents Importation Prohibition Regulations (see footnote 2) are repealed.

HONEYBEE IMPORTATION PROHIBITION REGULATIONS, 2004

3. The Honeybee Importation Prohibition Regulations, 2004 (see footnote 3) are repealed.

COMING INTO FORCE

4. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

Issues

These regulatory amendments address comments received from the Standing Joint Committee for the Scrutiny of Regulations (SJCSR) by adding a definition to and correcting a discrepancy in section 1 of the Compensation for Destroyed Animals Regulations (Compensation Regulations) made pursuant to section 55 of the Health of Animals Act (the Act).

The Honeybee Importation Prohibition Regulations, 2004 (Honeybee Regulations) and the Prairie Dog and Certain Other Rodents Importation Prohibition Regulations (Prairie Dog Regulations) made pursuant to section 14 of the Act are now spent and require repeal.

Objectives

To respond to, and resolve certain issues identified by the SJCSR by amending the Compensation Regulations to clarify provisions, reduce confusion, and increase consistency in interpretation.

To clarify the Canadian Food Inspection Agency’s (CFIA) current regulatory authorities by removing spent regulatory instruments.

Description

These regulatory amendments respond to recommendations made by the SJCSR and address non-substantive issues identified by the CFIA.

Both the Honeybee Regulations and the Prairie Dog Regulations were originally implemented to address emerging animal health issues. Both of these regulatory instruments are now spent and require repeal.

Section 1 of both the English and French versions of the Compensation Regulations has been amended as follows to address recommendations made by the SJCSR:

“One-for-One” Rule

The “One-for-One” Rule applies, as the CFIA is repealing two regulation titles that are considered to be “outs.” There is no administrative burden associated with these amendments, as they are minor in nature and the repealed regulations are spent.

Small business lens

The small business lens does not apply to these regulatory amendments or repeals, as there are no costs to small business.

Consultation

Consultation was not conducted, as these regulatory amendments and repeals are considered to be minor in nature and do not impact government policy, industry, or Canadians. The amendments and repeals will be posted on the CFIA’s Web site along with the accompanying Regulatory Impact Analysis Statement.

Rationale

These regulatory amendments address commitments made by the CFIA to resolve certain issues identified by the SJCSR.

The addition of the definition and the harmonization of the English and French text in the Compensation Regulations serve to clarify regulatory provisions, reduce confusion, and increase consistency in interpretation. The repeal of two regulations removes spent regulatory instruments and serves to clarify the CFIA’s current regulatory authorities.

These amendments and repeals have no cost to or impact on government policy, industry, or Canadians.

Implementation

These regulatory amendments come into force upon registration.
