Regulations Amending the Food and Drug Regulations (Part J — Salvia Divinorum)

His Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to subsection 55(1) (see footnote a) of the Controlled Drugs and Substances Act (see footnote b), makes the annexed Regulations Amending the Food and Drug Regulations (Part J — Salvia Divinorum).

REGULATIONS AMENDING THE FOOD AND DRUG REGULATIONS (PART J — SALVIA DIVINORUM)

AMENDMENTS

1. The portion of item 1 of Part I of the Schedule to Part G of the Food and Drug Regulations (see footnote 1) before subitem (1) is replaced by the following:

1. Amphetamines, their salts, derivatives, isomers and analogues and salts of derivatives, isomers and analogues, excluding those substances set out in item 1 of Part I of the schedule to Part J but including:

2. (1) The portion of subsection J.01.002(1) of the Regulations before paragraph (a) is replaced by the following:

J.01.002. (1) The following persons are authorized to have a restricted drug other than a restricted drug listed in Part II of the schedule to this Part in their possession:

(2) Subsections J.01.002(2) and (2.1) of the Regulations are replaced by the following:

(2) A person is authorized to have a restricted drug other than a restricted drug listed in Part II of the schedule to this Part in their possession if the person is acting as the agent or mandatary of a person referred to in paragraph (1)(a), (b) or (d).

(2.1) A person is authorized to have a restricted drug other than a restricted drug listed in Part II of the schedule to this Part in their possession if

3. The portion of section J.01.028 of the Regulations before paragraph (a) is replaced by the following:

J.01.028. Every licensed dealer who is in possession of a restricted drug, every institution to which the sale of such a drug has been authorized by the Minister and every person who is in possession of a restricted drug other than a restricted drug listed in Part II of the schedule to this Part shall

4. The schedule to Part J of the Regulations is amended by replacing the reference after the heading “SCHEDULE” with the following:

5. The schedule to Part J of the Regulations is amended by adding the following before item 1:

6. The schedule to Part J of the Regulations is amended by adding the following after item 23:

1. Salvia divinorum (S. divinorum), its preparations and derivatives, including:

(1) Salvinorin A ((2S,4aR,6aR,7R,9S,10aS,10bR)-9-(acetyloxy)-2-(3-furanyl)dodecahydro-6a,10b-dimethyl-4,10-dioxo-2H-naphtho[2,1-c]pyran-7-carboxylic acid methyl ester)

COMING INTO FORCE

7. These Regulations come into force 180 days after the day on which they are published in the Canada Gazette, Part II.
