DÉLINE FINAL SELF-GOVERNMENT AGREEMENT ACT

Order Fixing September 1, 2016 as the Day on which Certain Sections of the Act Come into Force

His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to section 43 of the Déline Final Self-Government Agreement Act, chapter 24 of the Statutes of Canada, 2015, fixes September 1, 2016 as the day on which sections 1 to 18 and 20 to 41 of that Act come into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

Proposal

Pursuant to section 43 of the Déline Final Self-Government Agreement Act (the Act), this Order fixes September 1, 2016, as the date on which sections 1 to 18 and 20 to 41 of the Act come into force.

Objective

Bringing sections 1 to 18 and 20 to 41 of the Act into force will give effect to the remaining provisions of the Déline Final Self-Government Agreement.

Background

On March 10 to 12, 2014, the Déline First Nation Band and the Déline Land Corporation held a vote to determine whether to ratify the Déline Final Self-Government Agreement and ancillary agreements. A strong majority voted in favour of the Déline Final Self-Government Agreement.

The Déline Final Self-Government Agreement was signed by the parties on February 18, 2015.

The Legislative Assembly of the Northwest Territories unanimously passed its implementing legislation on March 4, 2015, then gave assent on March 12, 2015.

The Act received royal assent on June 18, 2015.

Clause 19 came into effect on royal assent giving retroactive effect to certain provisions of the Déline Final Self-Government Agreement as of October 1, 2013.

Clause 42 came into effect on royal assent to provide for the coordinating amendments of the Act at such time they are required.

Implications

There are no financial implications to bringing the Act into force beyond those identified at the time the Act was enacted by Parliament.

Consultation

Neighboring Sahtu communities have been consulted on the Déline Final Self-Government Agreement prior to initialing through the representative body of Sahtu land claim beneficiaries, the Sahtu Secretariat Incorporated. No concerns were raised. Overlapping groups were also consulted on the Déline Final Self-Government Agreement and on the draft legislation. The Sahtu Secretariat Incorporated and the Dene Nation endorse the Déline Final Self-Government Agreement. There are no overlapping land claims or transboundary claims affected by, nor created as a result of, the Déline Final Self-Government Agreement.
