Regulations Amending the National Energy Board Onshore Pipeline Regulations

The National Energy Board, pursuant to subsection 48(2) (see footnote a) of the National Energy Board Act (see footnote b), makes the annexed Regulations Amending the National Energy Board Onshore Pipeline Regulations.

His Excellency the Governor General in Council, on the recommendation of the Minister of Natural Resources, pursuant to subsection 48(2) (see footnote c) of the National Energy Board Act (see footnote d), approves the annexed Regulations Amending the National Energy Board Onshore Pipeline Regulations made by the National Energy Board.

Regulations Amending the National Energy Board Onshore Pipeline Regulations

Amendments

1 The National Energy Board Onshore Pipeline Regulations (see footnote 1) are amended by adding the following after section 47.1:

Damage Prevention Program

47.2 A company shall develop, implement and maintain a damage prevention program that anticipates, prevents, manages and mitigates damage to its pipeline and meets the requirements set out in section 16 of the National Energy Board Pipeline Damage Prevention Regulations — Obligations of Pipeline Companies.

2 Subsection 55(1) of the Regulations is amended by striking out “and” at the end of paragraph (d), by adding “and” at the end of paragraph (e) and by adding the following after paragraph (e):

Application Prior to Publication

3 For the purposes of paragraph 11(2)(a) of the Statutory Instruments Act, these Regulations apply before they are published in the Canada Gazette.

Coming into Force

4 These Regulations come into force on the first day on which both sections 15 and 34 of the Pipeline Safety Act, chapter 21 of the Statutes of Canada, 2015, are in force, but if they are registered after that day, they come into force on the day on which they are registered.
