Regulations Amending the Vessel Operation Restriction Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 136(1) (see footnote a) and section 207 (see footnote b) of the Canada Shipping Act, 2001 (see footnote c), makes the annexed Regulations Amending the Vessel Operation Restriction Regulations.
Regulations Amending the Vessel Operation Restriction Regulations
Amendments
1 (1) Subsection 2(5) of the Vessel Operation Restriction Regulations (see footnote 1) is replaced by the following:
(5) No person shall operate a power-driven vessel or a vessel driven by electrical propulsion in the waters described in columns 1 to 3 of Schedule 6 in excess of the maximum speed set out in column 4 of that Schedule, except as indicated in that Schedule.
(2) Subparagraph 2(8)(b)(ii) of the Regulations is replaced by the following:
- (ii) in any waters referred to in Schedule 6 in respect of which a maximum speed is set out.
2 Subsection 11(3) of the French version of the Regulations is replaced by the following:
(3) Il est interdit à toute personne de tenir dans les eaux visées à l’un ou l’autre des paragraphes 2(1) à (7) une activité ou un événement sportifs, récréatifs ou publics au cours duquel des bâtiments seraient utilisés contrairement à ce que prévoient ces paragraphes, à moins d’y être autorisée par un permis délivré en vertu du paragraphe 12(1).
3 Subsection 12(1) of the French version of the Regulations is replaced by the following:
12 (1) Le ministre délivre un permis autorisant une personne à tenir dans les eaux visées à l’un ou l’autre des paragraphes 2(1) à (7) et 11(2) une activité ou un événement sportifs, récréatifs ou publics au cours duquel des bâtiments seront utilisés d’une manière contraire à ce que prévoient ces paragraphes si le ministre est en mesure d’assortir le permis de conditions pour protéger l’intérêt public et l’environnement et réduire au minimum le risque pour la sécurité des personnes et les entraves à la sécurité et à l’efficacité de la navigation des bâtiments.
4 Paragraph 14(1)(b) of the Regulations is replaced by the following:
- (b) any time after 11:00 p.m. of one day and before 9:00 a.m. of the following day.
5 Subsection 15(2) of the Regulations is replaced by the following:
(2) A person who operates a vessel during a sporting, recreational or public event or activity for which a permit has been issued shall do so in a manner that does not interfere with the event or activity.
6 The table to section 16 of the Regulations is replaced by the following:

REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Issues
Amendments to Vessel Operation Restriction Regulations (the Regulations) are being made in response to comments received from the Standing Joint Committee for the Scrutiny of Regulations (SJCSR). Transport Canada (TC) is making corrections, amendments and clarifications to the Regulations to correct the issues of discordance outlined in the correspondence between the SJCSR and TC.
Background
The Regulations, made pursuant to subsection 136(1) and section 207 of the Canada Shipping Act, 2001 (CSA 2001), provide for the establishment of restrictions to boating activities and navigation on Canadian waters. Increased water activities due to population growth and the technical evolution of vessels have resulted in more people using waterways, leading to a potential increased safety risk to users.
Objectives
The objective of the amendments is to address and correct the issues identified by the SJCSR.
Description
The Regulations provide for the establishment of restrictions to boating activities and navigation in Canadian waters. The restrictions set out in the Regulations include: prohibitions with respect to access by vessels to specified waters; restrictions on the mode of propulsion used; maximum engine power or speed limits; and prohibitions on recreational towing (e.g. water-skiing) activities. The Schedules to the Regulations also specify waters in which a permit is required in order to hold a sporting, recreational or public event or activity (e.g. regattas and dragon boat races).
The changes to the Regulations include
- amending paragraph 14(1)(b), related to anchorage in False Creek in the City of Vancouver, to clarify the intent of the provision and to eliminate any unintended conflict with the period set out in paragraph (a);
- amending the Table in section 16 to include a geographic location for each entry;
- merging Schedules 5 and 6 to avoid unnecessary duplication;
- amending the Schedules to the Regulations to standardize 185 entries to reflect the Gazetteer of Canada’s reference system;
- amending the Schedules to the Regulations to correct the geographical coordinates of 13 entries;
- eliminating discrepancies between the English and French versions; and
- correcting grammatical and typographical errors or omissions.
“One-for-One” Rule
The “One-for-One” Rule does not apply, as there is no change in the administrative costs to businesses.
Small business lens
The small business lens does not apply, as there are no costs to small businesses.
Consultation
The amendments to the Regulations make changes proposed by the SJCSR and are administrative in nature. Since the changes are administrative in nature and no new restrictions or major changes are being sought, TC determined that detailed public consultations were unnecessary.
Rationale
The intent of these amendments is to enhance the safety of commercial and recreational navigation on Canadian waters. By ensuring the Regulations contain correct information (e.g. correct geographical coordinates) and are clearly worded (e.g. concordance between French and English versions), less regulatory misinterpretation can be expected, which will contribute to a reduction in confusion between users of the waterways and enforcement partners.
Implementation, enforcement and service standards
The Contraventions Regulations, made pursuant to the Contraventions Act, set out prescribed fine amounts for contraventions of regulations made under the CSA 2001. The Regulations have specific contravention amounts to a maximum of $500 under the Contraventions Regulations. Enforcement is by way of summary conviction or ticketing under the Contraventions Act. The Regulations specify the classes of persons who are entitled to enforce the Regulations and include, for example, the Royal Canadian Mounted Police (RCMP), provincial and municipal police forces, as well as other groups such as special constables, conservation officers, wildlife officers, marine safety inspectors and marine patrol officers.
