Regulations Amending the Mackenzie Valley Land Use Regulations (Miscellaneous Program)

His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to section 90 (see footnote a) of the Mackenzie Valley Resource Management Act (see footnote b), makes the annexed Regulations Amending the Mackenzie Valley Land Use Regulations (Miscellaneous Program).
Regulations Amending the Mackenzie Valley Land Use Regulations (Miscellaneous Program)
1 Paragraph 18(b) of Schedule 2 to the Mackenzie Valley Land Use Regulations (see footnote 1) is amended by replacing “the Application fee, rounded up to the next whole hectare” with “the Application fee”.
2 The French version of the Regulations is amended by replacing “office” with “Office” in the following provisions:
- (a) the definition of office in section 1;
- (b) paragraph 12(b);
- (c) subsection 16(2); and
- (d) section 43.
3 These Regulations come into force on the day on which they are registered.

Issues
The Standing Joint Committee for the Scrutiny of Regulations has identified a few technical issues falling from the Regulations Amending the Mackenzie Valley Land Use Regulations (SOR/2016-128) and has recommended that the Mackenzie Valley Land Use Regulations (SOR/98-429) be amended to address the following:
- The term “office” was changed to “Office” throughout the French version of the Regulations to correspond with the English version “Board.” This change was omitted in section 1 (English and French versions) and section 43 of the French version of the Regulations. The amendments made through SOR/2016-128 reintroduced “office” into paragraph 12(b) and subsection 16(2) of the French version of the Regulations.
- Under Schedule 2 — Paragraph 18(b), the Standing Joint Committee for the Scrutiny of Regulations stated that the provision “rounded up to the next whole hectare” which had been introduced in an application form was not permitted as it established a new rule for the calculation of fees that is not prescribed by the Regulations. This provision should be removed.
Objectives
The objectives of the amendments to the Regulations are to
- correct typographical errors (i.e. to change the word “office” to “Office”) in
- section 1 of the English version of the Regulations;
- section 1, paragraph 12(b), subsection 16(2) and section 43 of the French version of the Regulations,
- remove an illegal fee calculation rule in the application form contained in Schedule 2 of the English and French versions of the Regulations.
Description
A few amendments address typographical errors in the Regulations by replacing the word “office” to “Office” in the following provisions:
- section 1:
- English version — the reference at the conclusion of the definition of “Board” in paragraph 1(d);
- French version — the defined term in section 1;
- paragraph 12(b):
- French version — the reference at the beginning of the paragraph;
- subsection 16(2):
- French version — the reference at the beginning and at the end of the subsection;
- section 43:
- French version — the defined word.
An amendment to paragraph 18(b) of Schedule 2 of the Regulations removes the provision “rounded up to the next whole hectare” as it sets out a substantive rule for the calculation of fees that is not prescribed elsewhere in the Regulations.
“One-for-One” Rule
The “One-for-One” Rule does not apply to these amendments, as there is no change in administrative costs or burden to business.
Small business lens
The small business lens does not apply to these amendments, as there are no costs to small business.
Rationale
The amendments are in response to a review of the Regulations Amending the Mackenzie Valley Land Use Regulations (SOR/2016-128) conducted by the Standing Joint Committee for the Scrutiny of Regulations. The amendments provide precise and clear regulations by ensuring consistency in the use of terms and the removal of a rule that is not prescribed by the Mackenzie Valley Land Use Regulations. The amendments help to correct the regulatory base, and do not impose any costs on the Government or stakeholders.
