His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraphs 23(a) and (e) (see footnote a) of the Territorial Lands Act (see footnote b), makes the annexed Order Repealing the Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order.

Repeal
1 The Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order (see footnote 1) is repealed.

Proposal
To repeal the Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order, made by Order in Council P.C. 2014-317 of March 27, 2014, pursuant to paragraph 23(a) and (e) of the Territorial Lands Act.
Objective
The purpose of this Order in Council is to repeal the Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order. This Order is for administrative purposes as required by paragraph 23(a) and (e) of the Territorial Lands Act.
Background
The Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order (the Order) was made at the time of devolution to replace the previous Order of the same name. It corrected an issue with the designation of the limits of the reindeer reserve and removed the restrictions on the granting of new prospecting permits under the Northwest Territories and Nunavut Mining Regulations and the issuance of new interests under the Canada Petroleum Resources Act in the reserve. This was done at that time so that the Northwest Territories would mirror the corrected Order, which they did.
The administration and control of the lands affected by the Order were transferred to the Commissioner of the Northwest Territories at the time of devolution in 2014. However, the Order was never repealed. This creates confusion as to whether the Order continues to have any effect or not. It is suspected that it does not, because the objective of the Order is to prevent certain actions of the federal government, that because of devolution, it can no longer perform anyway.
The Order recommends that the Governor General in Council, pursuant to paragraph 23(a) and (e) of the Territorial Lands Act, repeals the Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order, made by Order in Council P.C. 2014-317 of March 27, 2014.
Implications
This Order has no direct or indirect financial implications for which approval of the Treasury Board is required and no grants or contributions are associated with this Order. Routing procedures, as outlined in the directives on submissions, have been followed.
Consultations
This Order is for administrative purposes as required by paragraph 23(a) and (e) of the Territorial Lands Act.
Reaction was positive from Indigenous groups and the Government of the Northwest Territories who were consulted on the proposed repeal Order.
